Contract Documents: The following comprise the Contract Documents. <br /> <br />a. Invitation for Bids <br />b, Instructions to Bidders <br />c. Federal Wage Guidelines <br />d. Bid Bond <br />e. Addendurns <br />f. Proposal Forms <br />g. Notice of Award <br />h. Agreement <br />i. Performance Bond <br />j. Notice to Proceed <br />k. General Conditions <br />1. Measurement and Payment <br />m. Detail and Technical Specifications <br />n. Drawings <br /> <br />Wherever the word "Cont:ract" appears, it shall be held to include a.II the <br />above. <br /> <br />2. Bid In filling out the bid form, Bidders shall be governed by the <br />following principles. Bids shall be made on the form provided. In case <br />of an error in calcula1:ion, the unit bid price shall govern. Prices <br />shall be typeNritten OJ::' printed in ink. The Bid must be signed ';:;y an <br />authorized representative of the Bidder. The Town of Milliken reserves <br />the right to reject any or all Bids or accept only a portion of any Bid. <br /> <br />3. Bid Guaranty: Each Bid must be accompanied by a Bid Bond or a certified <br />check in the amount of five percent of the base Bid. Each Bid shall be <br />f inn and binding upon the Bidder and the Bid Guaranty shall be held by <br />the Town of Milliken until such Bid is accepted or rejected, If the suc- <br />cessful Bidder fails to enter into a contract within five days of the <br />Notice of Award, the ~.ner shall be entitled to collect the amount of the <br />Bid Guaranty as liquidated damages. <br /> <br />4. Substitutions: If in the Drawings and Specifications, any material is <br />mentioned by a proprietary name, the Contractor may furnish any material <br />equal to that specified, if accepted in writing by the Engineer, The <br />Contractor shall be responsible for proof of equality. <br /> <br />5. Familiarization: Each Bidder shall be deemed to have made a careful exa- <br />mination of the work site and the Contract Documents. Each Bidder shall <br />be familiar with all applicable federal, state, and local laws and regu- <br />lations which may affect the proposed work. There will be no financial <br />adjustment to any Contract award because of a lack of familiarization. <br />
