Based on my inquiry of the person or persons who manage the <br />system, or those persons directly responsible for gathering the information, the information submitted is, <br />to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are <br />significant penalties for submitting false information, including the possibility of fine and imprisonment <br />for knowing violations." <br /> <br />2. Retention of Records <br /> <br />a) The permittee shall tetain copies of the SWMP and all repons required by this permit and tecords of all data <br />used to compete the application to be covered by this permit, for a period of at least three years from the date <br />that the site is finally stabilized. <br /> <br />b) The permittee shall retain a copy of the SWMP required by this permit at the construction site from the date <br />of project initiation to the date of final stabilization. <br /> <br />PART II <br /> <br />A. MANAGEMENT REQUIREMENTS <br /> <br />1. Chan!!e in Disch3I'2e <br /> <br />The permittee shall inform the Division (Permits and Enforcement Section) in writing of any intent to construct, <br />install, or alter any process, facility, or activity that is likely to result in a new or altered discharge, and shall <br />furnish the Division such plans and specifications which the Division deems reasonably necessary to evaluate the <br />effect on the discharge and receiving stream. The SWMP shall be updated within 30 days of the changes. <br /> <br />The permittee shall submit this notice to the Division within two weeks after making a determination to perform the <br />type of activity referred to in the preceding paragraph. <br /> <br />Any discharge to the waters of the State from a point source other than specifically authorized by this permit is <br />prohibited. <br /> <br />2. Special Notifications - Definitions <br /> <br />a) Spill: An unintentional release of solid or liquid material which may cause pollution of state waters. <br /> <br />b) Upset: An exceptional incident in which there is unintentional and temporary noncompliance with permit <br />effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not <br />include noncompliance to the extent caused by operational error, improperly designed treatment facilities, <br />inadequate treatment facilities, lack of preventative maintenance, or careless or improper operation. <br /> <br />3. NoncomDliance Notification <br /> <br />a) If, for any reason, the permittee does not comply with or will be unable to comply with any permit <br />limitations, standards or permit requirements specified in this permit, the permittee shall, at a minimum, <br />provide the Water Quality Control Division and EPA with the following information: <br /> <br />I) A description of the discharge and cause of noncompliance; <br /> <br />2) The period of noncompliance, including exact dates and times andlor the anticipated time when the <br />discharge will teturn to compliance; and <br />
