Federal Role <br />The National Flood Insurance Act of 1968 was enacted by Title XIII <br />of the HoUSin9 and Urban Development Act of 1968 (Public Law 90- <br />448, AU9ust 1, 1968) to provide previously unavailable flood insurance <br />protection to property owners in flood-prone areas, The Act provides <br />that flood insurance shall not be sold or renewed under the program <br />within a community, unless the community has adopted adequate flood- <br />plain management regulations consistent with federal criteria, <br />In all cases the minimum requirements governing the adequacy of <br />floodplain management regulations for flood prone areas depend upon <br />the amount of technical data provided to the community by the Federal <br />Emergency Management Agency (FEMA), The National Flood Insurance <br />Program (NFIP) regulations are set forth in CFR 44 Parts 59-78, <br /> <br />B. Generalized NFIP Community Categories <br />Basically, communities fall into three categories which are deter- <br />mined by the level of flood identification (mapping) which exists for the <br />community, As set torth in the Federal Register 46968, October 26, <br />1976, these categories presently correspond to Section 60,3b (Category <br />1); Section 60,3c (Category 2); and Section 60,3d (Category 3), <br />Category 1 - Communities which have flood hazards identified <br />(mapped) by approximate engineering methods, Essentially, the flood <br />hazard has not been specifically defined, water surface elevation <br />data has not been provided and a floodway has not been Identified, <br />The community has, however, indicated the presence of such <br />hazards by submitting an application to participate in the National <br />Flood Insurance Program (NFIP), <br />Most communities that fall into this category participate in the <br />Emergency Phase of the NFIP, Presently, there Is a concerted eftort <br />by FEMA with assistance trom the Colorado Water Conservation <br />Board to convert all of Colorado's Emergency Phase communities <br />into the Regular Phase of the NFIP by September 30, 1991, <br />Category 2 - Communities which have flood hazards identified <br />(mapped) by detailed engineering methods, Water surface elevations <br />have been provided but a floodway has not been identified, <br />Category 3 - Communities which have flood hazards identified <br />(mapped) by detailed engineering methods, Water surface elevations <br />have been provided and a flood way has been identified, <br /> <br />C. Floodplain Permitting Responsibilities <br />In the case of all three categories, a community must require permits <br />for all proposed construction and other development, including place, <br />ment of manufactured (formerly mobile) homes, so that it may determine <br />whether such construction or other development is proposed within <br />floodprone areas, All permits must be reviewed to determine whether <br />proposed building sites will be reasonably safe from flooding, <br />The following NFIP Administrative Procedures Manual identifies the <br />process and procedures a local floodplain administrator should follow to <br />maintain eligibility for participating in the National Flood Insurance Pro' <br />gram (NFIP),The procedures apply to all communities, However, the <br />degree of sophistication by which a local floodplain management pro- <br />gram is administered will vary depending upon the level of identification <br />(mapping) tor a given community, <br /> <br />5 <br />
