In some instances, additional data may be required for FEMA to <br />make a determination, These may consist of, but not be limited to, <br />certifications by a registered professional engineer or a licensed <br />land surveyor as to the type of structure and whether it is elevated <br />on pots, piers, pilings, or barrier sand dunes; or a hydraulic <br />analysis of the flooding conditions, <br />. To support a request involving fill that was placed before the <br />effective date of the first NFIP map showing the structure or par- <br />cel of land to be within the SFHA, a requestor may be required to <br />submit a certification of the date the fill was placed, This certifica- <br />tion may be made by a community official, registered professional <br />engineer, or licensed land surveyor. <br />. When the effective NFIP map is on FH8M, 8FE's wiil not be <br />shown, The requestor may either determine on approximate 8FE. <br />FEMA will either check the 8FE determined by the requestor or, if <br />necessary, determine an approximate 8FE using the supporting <br />data for the FH 8M or the best avaiiable data, <br />When a preliminary or revised preliminary FIRM has been issued, <br />the 8FE's shown on the FIRM may be used as best avaiiable data <br />after the 8FE's have been made final by FEMA. <br />. When the effective NFIP map is a FIRM, the determination con, <br />cerning the structure or parcel of land will be made using the <br />8FE's shown on the FIRM. Determinations cannot be made using <br />other flood elevations, unless the effective FIRM Is first revised to <br />incorporate the new elevations, <br />. When the effective FIRM shows an average depth of flooding <br />rather than a 8FE, the determination wiil be made by comparing <br />the elevations of the lowest grade adjacent to the structure to the <br />elevation of the surrounding terrain where sheet flow would be <br />conveyed, If the difference in these elevations is equal to or <br />greater than the flood depth shown on the effective FIRM, the <br />structure can be excluded from the SFHA. <br />. When the SFHA on the effective FI RM is designated as approx- <br />imate Zone A no 8FE's wiil be shown, If the structure is located in <br />approximate Zone A, a 8FE may be determined by the same <br />method as that used when the effective map in an FH8M, <br />. Structures that have been elevated above the 8FE on posts, piers, <br />or pilings cannot be excluded from the SFHA if any portion of the <br />structure (including the posts, piers, or pilings) is stiil in the SFHA. <br />. Regardless of the elevations of the lowest adjacent grades and <br />lowest floor, LOMA's wiil not be issued to exclude from the SFHA <br />structures located in floodways or in Zone V or in areas that are <br />anticipated to be designated as floodways or Zone 8, <br />No determinations can be made until the floodway has been revised <br />to exclude the structure or until the Zone V designation for the area in <br />which the structure is located has been changed, Changes to floodways <br />are discussed in the following section titled "flood way revisions", <br />Changes to zone designations shown on effective maps are made under <br />the Map Revision process, <br /> <br />E. Map Amendment Procedures <br />After a request has been received, FEMA wiil aCknowledge receipt of <br />the requestor, This letter will be accompanied by a checklist that Iden, <br />tifies any basic data the requestor may have neglected to submit. If suf- <br />ficient data have been provided with the request, FEMA wiil review the <br />request and the supporting data, If any questions or problems arise dur, <br />ing this review, FEMA will work with the requestor to resolve them, <br /> <br />If the missing data identified on the checklist are not provided within <br />30 days of the date of the acknowledgment letter, a data request letter <br />wiil be sent to the requestor, This letter will ail ow the requestor 30 <br />more days to provide the necessary data, If these data are not provided <br />within the allowed time, FEMA will generally drop the request. If the <br />requested data are provided, FEMA will complete the review and issue <br />the appropriate LaMA, Generally the LaMA will be issued within 4 to 8 <br />weeks of the date that all the required supporting data are received, <br />When FEMA determines that, based on the legal description or <br />recorded plat, the structure is located outside the SFHA shown on the <br />effective NFIP map, a LaMA will be issued stating that the structure is <br />"out as shown", <br /> <br />31 <br />
