<br />e <br /> <br />installed units change the total CONTRACT value as originally bid by more than five <br />(5) percent, the CONTRACTOR or the OWNER may request that the unit price of <br />that particular unit designation be renegotiated. <br /> <br />Unlike the lump sum CONTRACT, CHANGE ORDERS are not necessary when the <br />number of actual units installed is either less or more than indicated in the <br />CONTRACT DOCUMENTS. A CHANGE ORDER will be issued if a unit price <br />adjustment has been agreed upon. <br /> <br />20.04 COST ADJUSTMENT FOR CHANGE ORDERS. When a price adjnstment cannot <br />be expressed at the time a CHANGE ORDER is issued (either because the full effect <br />of the change cannot be determined or because agreement cannot be reached), the <br />CONTRACTOR and his SUBCONTRACTORS shall i=ediately estllblish special <br />accounts designed to accumulate costs and credits resulting from the CHANGE <br />ORDER. Applicable costs and credits shall be posted daily, and a copy of each <br />posting shall be certified by signature of the CONTRACTOR and shall be transmitted <br />to the Resident Engineer on a daily basis. <br /> <br />FaIlure of the Resident Engineer to object to any item posted to these accounts shall <br />not be construed to be approval of that item. It is only intended that this procedure <br />will permit substantial agreement when the value of the CHANGE ORDER is finally <br />negotiated. <br /> <br />Should the final value of a CHANGE ORDER be determined on the basis of actual <br />COSts and credits, the procedure shall be known as a cost adjustment. <br /> <br />e <br /> <br />Under this cost adjustment, all direct costs and credits to the CONTRACTOR or any <br />of its SUBCONTRACTORS will be consolidated into a plus or minus dollar sum <br />separately for each of the categories; labor, materials and machinery, equipment <br />rental, and other services or expenditures. After the CONTRACTOR's and <br />SUBCONTRACTOR's costs and credits have been accumulated, the net amount of <br />labor, materials and machinery and for other services or expenditures will be <br />multiplied by not more than 1.15 (115%). Except as shown below, the sums for <br />equipment rental will not be multiplied by the 1.15 (115%) amount. <br /> <br />Under the labor category, the CONTRACTOR and SUBCONTRACTORS shall <br />include all gross payments to employees involved in the CHANGE together with all <br />other charges against that labor. Credits will be determined in the Same way. This <br />hourly payment shall not exceed current Davis-Bacon Act provisions. <br /> <br />The materials and machinery category does not include expendable supplies but does <br />include all material and machinery to be incorporated into the WORK as required by <br />the CHANGE. Vendor invoices are acceptable evidence of material and machinery <br />COSts. To these the CONTRACTOR may add reasonable sums to cover delivery and <br />insurance costs. If a credit to the OWNER is dne on materials and machinery already <br />purchased, the credit may be decreased by the sums of money which the <br />CO;-.iTRACTOR cannot recover even if the vendor accepts return of the materials or <br />machinery . <br /> <br />e <br /> <br />Other services or expenditures include expendable supplies used to accomplish the <br />CHANGE, employment of materials testing laboratories, employment of design <br />professionals and surveyors and any other expense directly related to accomplishment <br />of the CHANGE but not perruitted in other categories. <br /> <br />Equipment rental rates, as published by the Colorado Departtnent of Highways, may <br /> <br />III-17 <br />(1723 - 10/93) <br /> <br /> <br />- <br />
