<br />e <br /> <br />e <br /> <br />e <br /> <br />'> <br /> <br />., <br />i <br />;,.; <br /> <br />GC-19 <br /> <br />GC-20 <br /> <br />adjust any such claims asserted before the date of final payment. <br /> <br />The inclusion of the boring logs and utility information including, without limitation, utility <br />location and size in the construction drawings shall not be construed to be a waiver of the <br />CONTRACTOR's obligation to inspect the soils conditions and utility information himself <br />before submitting a bid. By submitting a bid, the CONTRACTOR acknowledges that he has <br />satisfied himself as to the nature of the work including, but not restricted to, the conditions <br />affecting handling and storage of materials, disposal of excess material, and level and amount <br />of groundwater. There shall be no additional compensation for underground or soils conditions <br />different from those shown on the test logs, nor additional compensation as a result of utility <br />information including, without limitation, utility location and size different from those shown <br />on the drawings. <br /> <br />NO DAMAGE FOR DELAY. Notwithstanding the foregoing, the CONTRACTOR agrees to <br />make no claim for monetary compensation for delay in the performance of this contract <br />including but not limited to those occasioned by any action or omission to act of the OWNER <br />or any of OWNER's representatives or agents or employees or for delay occasioned by any <br />alleged or actual change in conditions, and agrees that any such claim shall be fully <br />compensated for by an extension of time to complete performance of the work as specified in <br />the General Conditions, Section 22. <br /> <br />CHANGES IN WORK (CHANGE ORDER AND FIELD ORDERS). <br /> <br />20.01 GENERAL. The OWNER may at any time, as the need arises, order changes within <br />the scope of the WORK without invalidating the Agreement. If such changes increase <br />or decrease the amount due under the CONTRACT DOCUMENTS, or in the time <br />required for performance of the WORK, an equitable adjustment shall be authorized <br />by CHANGE ORDER. <br /> <br />20.02 CHANGES IN CONTRACT PRICE. The CONTRACT PRICE may be changed only <br />by a CHAI'iGE ORDER. The value of any WORK covered by a CHANGE ORDER <br />or of any claim for increase or decrease in the CONTRACT PRICE shall be <br />determined by one or more of the following methods in the order of precedence listed <br />below: <br /> <br />a. Unit prices previously approved as detailed in subparagraph 20.03. <br /> <br />b. An agreed lump sum as detailed in GC-l2. <br /> <br />c. The actual cost for labor, direct overhead, materials, supplies~ equipment, and <br />other services necessary to complete the work. In addition there shall be added <br />an amount to be agreed upon but not to exceed a total of fifteen (15) percent of <br />the actual cost of the WORK to cover the cost of general overhead and profits <br />as detailed in subparagraph 20.04. Under no circumstances will the OWNER <br />be liable for any extra work which has not been authorized by a properly <br />executed change order. <br /> <br />20.03 UNIT PRICE CONTRACTS. If payment for the major part of the WORK done under <br />the CONTRACT is based on specially identified units of construction rather than on <br />a lump sum price, the CONTRACT will be known as a unit price CONTRACT. In <br />the case of the unit price CONTRACT, the number of units of specific type as set <br />forth in the PROPOSAL may vary from the number of units actually measured when <br />the WORK has been completed. Should the installed number of units of anyone unit <br />designation vary by more than twenty-five (25) percent from the number originally <br />stated in the PROPOSAL for that designation and should this difference in number of <br /> <br />III-16 <br />(1723 - 10/93) <br />
