<br />e <br /> <br />e <br /> <br />e <br /> <br />performance of the WORK. <br /> <br />13.05 <br /> <br />PERMITS AND LICENSES. All permits, licenses, and approvals reqnired in the prosecution <br />of the WORK shall be obtained and paid for by the CONTRACTOR except the USACE 404 <br />Permit which will be obtained by the Owner. The CONTRACTOR shall also be responsible <br />for the payment of any applicable taxes, tap fees, development fees, or other charges and fees <br />imposed by utility companies or governmental agencies responsible for imposing such fees or <br />taxes and/or providing such services to the facility or facilities to be constructed hereunder. <br /> <br /> <br />13.06 TEMPORARY CONSTRUCTION AND SECURITY FACILITIES. The CONTRACTOR <br />shall provide all materials, tools, equipment and labor necessary for dewatering, water control, <br />temporary pumping facilities, bypassing of sewage, traffic control, pedestrian and vehicular <br />bcrricades, detours, signing, temporary fencing, and all other related temporary construction <br />ar.d security facilities necessary to perform the work in accordance with CONTRACT <br />DOCUMENTS. <br /> <br />13.07 SUPERVISION BY CONTRACTOR. The CONTRACTOR will supervise and direct the <br />WORK and manage any SUBCONTRACTORS' WORK. He will be solely responsible for the <br />means, methods, techniques, sequences and procedures of construction. The CONTRACTOR <br />will employ and maintain on the WORK a qualified supervisor or superintendent who shall <br />have been designated in writing by the CONTRACTOR as the CONTRACTOR's <br />representative at the site. The supervisor shall have full authority to act on behalf of the <br />CONTRACTOR and all communications given to the supervisor shall be as binding as if given <br />to the CONTRACTOR. The supervisor shall be present on the site at all times as required to <br />perform adequate supervision and coordination of the WORK. <br /> <br />1308 <br /> <br />CONSTRUCTION MANPOWER. The CONTRACTOR shall assign an adequate number of <br />persons to each task so that an optimum rate of progress is maintained. The number of <br />assigned personnel is especially critical whenever an operation is begun which requires that the <br />activity be pursued at a rate needed to avoid the manufacture of an inferior product. <br /> <br />13.09 <br /> <br />CONSTRUCTION MACHINES. The CONTRACTOR shall have available for use when <br />needed all necessary construction machinery and equipment which is safe, in good working <br />cor.dition, and adequate for the task and in numbers needed to maintain an optimum rate of <br />progress. <br /> <br />13.10 <br /> <br />COSTS. Except as may be otherwise provided for in the PROPOSAL, no separate payment <br />wi]; be made for any of the items or requirements set forth under this General Condition and <br />all costs incurred will be considered to be included in the appropriate CONTRACT PRICES <br />bid <br /> <br />GC-14 <br /> <br />INSPECTION AND TESTING. <br /> <br />14.01 GENERAL. The OWNER, through its assigned INSPECTORS, and/or the <br />ENGINEER will observe WORK as the WORK progresses. The purpose of the <br />observation activity is to try to determine on an on-going basis whether or not the <br />CONTRACTOR's work is in general compliance with the contract requirements. <br />Whether or not the work or any part of the work is defective will be determined by <br />comparing it to the DRAWINGS and SPECIFICATIONS, supplemental drawings and <br />specifications and further measuring it against the standard of quality implied by the <br />CONTRACTOR's warranty. Also, should the appearance and performance of any <br />element of the WORK fail to conform to standards of the trade for such WORK, that <br />WORK may be declared defective. <br /> <br />All materials and equipment used in the construction of the PROJECT shall be subject <br /> <br />III-12 <br />(1723 - I /9i() <br />
