<br />1. PARTIES AND PURPOSE <br /> <br />This Memorandum of Understanding (MOU) establishes an agreement between the Colorado Water <br /> <br />Conservation Board, Department of Natural Resources, State of Colorado (hereafter CWCB) and the <br /> <br /> <br />Hydrometeorological Design Studies Center, Hydrology Laboratory, National Weather Service, National <br /> <br />Oceanic and Atmospheric Administration, US, Department of Commerce (hereafter NWS), through which <br /> <br />CWCB will pay NWS for an independent review ofthe Applied Weather Associates (hereafter A W A) <br /> <br />Probable Maximum Precipitation Study for Cherry Creek Reservoir. <br /> <br />2. AUTHORITY <br /> <br />The authority for CWCB and NWS to enter into this agreement is as follows: <br /> <br />The "Special Studies" authority, 15 U S. C. -1525 (first paragraph) which permits NWS to provide, upon the <br /> <br /> <br />request of any person, firm, or public or private organization (a) special studies on matters within <br /> <br />authority of the Department of Commerce, including preparing from its records, special compilations, <br /> <br />lists, bulletins, or reports, and (b) furnishing transcripts or copies of its studies, compilations, and other <br /> <br />records. <br /> <br />3. TERMS AND CONDITIONS <br /> <br />Scope of Work <br /> <br />NWS will provide an independent review of the CWCB Probable Maximum Precipitation Study for <br />Cherry Creek Reservoir including the following tasks: <br /> <br />Task l: Review the Draft Pinal Report of the A W A Probable Maximum Precipitation Study for <br />Cherry Creek Reservoir. <br /> <br />Any additional tasks will be agreed to in writing between CWCB and NWS. <br />
