STATE OF COLORADO

Colorado Water Conservation Board

Department of Natural Resources
1313 Sherman Sb'eet, Room 721
Denver, Colorado 80203
Phone: (303) 866-3441
FAX: (303) 866-4474
www.cwcb.state.co.lls

Bill Owens
Governor

MEMORANDUM

Greg E. Congressional actions regarding the Corps of Engineers' Funding Bill language for FY 2005
Cherry Creek Dam Safety Study Program - The funding language under their Operation and
Maintenance Funds (0 & M) has been the same for FY 01, FY 02, FY 03, and FY 04, which
is under the House Committee instructions. The language states:

"None of the funds provided for Operation and Maintenance at the Cherry Creek
Project in Colorado may be used to undertake a study of dam safety at tbe Project".

This language has placed a complete stop to any Corps of Engineers Dam Safety Study
activity at the Cherry Creek Reservoir. Congress placed this language in the Corps' funding
bill to bring attention to the public's concerns over the Corps' study
findings/recommendations. In response to the Corps' Cherry Creek Dam Safety issues a non-
federal technical review team was formed to perform a technical review of the Corp's 1995
Cherry Creek PMP Study. The review/study findings will be presented to the Committee on
April 2' 2003.

Question: Does the Committee want to consider the following language for an amendment to
the Corp's funding bill?

"Except limited funding may be used for a technical review of the existing and any new
Probable Maximum Precipitation (PMP) and collaborate on the performance of a
Probable Maximum Flood (PMF) study by others and the Corps".

2. Suggested review/study meeting schedule for the completion ofthe non-federal PMP
technical review for Cherry Creek Dam and Reservoir. A suggested schedule is:

Flood ProtectioIl . Water Supply Planning and Finance. Stream and Lake Protection
Water Supply Protection. Conservation and Drought Planning
