<br />Honorable Charles StruvE, <br />Page Three <br /> <br />The .review process will fully take into account any technical or scien- <br />tific data submitted by the community that tend to negate or contradict <br />the information upon which the proposed determination is based. The <br />appeal will be resolved by consultation with 'officials of the local <br />government involved, by administrative hearing, or by submission of the <br />conflicting data to an independent scientific body or appropriate <br />Federal agency for advice. The reports and other information used in <br />making the final determination will be made available for public inspec- <br />tion. Until the conflic.t of data is resolved, and until the Flood <br />Insurance Rate Map becomes effective, flood insurance previously avail- <br />able within the community shall continue to be available under the <br />Emergency Program, and r..o person shall be denied the right to purchase <br />the first level of insurance at chargeable rates. <br /> <br /> <br />The decision by the comrrunity to appeal, or a copy of its decision not <br />to appeal, should be filed with this office no later than 90 days fol- <br />lowing the second publication of proposed base flood elevations. <br /> <br /> <br />You may find it appropriate to call further attention to the proposed <br />base flood elevation determinations and to the appeal procedure by using <br />a press release or other public notice. <br /> <br />If warranted by substantive changes, this. office will revise and send to <br />you during the appeal period copies "of the Preliminary Flood I~surance <br />Study and Rate Map. The Revised Preliminary will include all appropriate <br />comments and corrections resulting from the final coordination meeting <br />held May 3, 1979. At the end of the 90-day appeal period and following <br />the resolution of any appeals, we shall send you the PROOF copy of the <br />study with a letter of final base flood elevation determinations. <br /> <br />If there are further questions regarding the flood elevation determi- <br />nations or the Flood Insurance Study for the community, please contact <br />the Office of.
