<br />Department of the Army <br />February 14, 1980 <br />Page Three <br /> <br />In summation, the Town staff approved the fill and rechannelization plans soon <br />thereafter and notified the developer that a Corp of Engineers permit would <br />most likely be required. The follow-up to that condition was lacking on our <br />part, and construction began in early June 1979. <br /> <br />Due to the nature of the Blue River as it flows through the old dredge tailings <br />construction was performed in a dry channel and work was halted once the flows <br />surfaced in late July. The Blue flows for approximately two months from July <br />to September. There was no contamination of a moving water course as a result <br />of the fill and the riverway was cleaned up prior to the winter, until construction <br />could be completed in 1980. We are confident that our staff review of all engineering <br />considerations was strict and comprehensive, and we regret that the violation occured. <br />" <br /> <br />We are at present experiencing a very zealous growth phase in the Town of Brec~en- <br />ridge, and find that many of our past regulations and design standards are inade- <br />quate for the variety of developments we are seeing now. The submittal and review <br />of more detailed drainage studies and improvements is being required under newly <br />revised subdivision regulations and a 404 Permit for any work in an established <br />water course will be a prerequisite before any construction phase. Strict bonding <br />for such improvements whether they be street or drainage in nature will be addi- <br />tionly required. The appropriate permits required for such work have in the ~ast <br />been required as just that. . . "appropriate" and I believe we can educate all <br />new developers as to what those specific permits are. Hopefully this violation <br />sahll be the first and last of its type. <br /> <br />I am confident that the work designed and performed by Sawmill Station Associates <br />within the limits of the Blue River water course do not pose direct threat to water <br />quality or constrict an.established floodway. The engineering calculations <br />appear correct and construction methods are consistant with the standards of <br />our planning and engineering guidelines. <br /> <br />I encourage you to accept and process the developers application for a Department <br />of the Army 404 permit and issue said permit as expeditiously as possible. I <br />am hopeful that these comments and background information will be valuable to <br />your assessment of the Blue River situation.
