<br />. <br /> <br />. <br /> <br />Allows the Colorado water conservation board to accept and expend grants and donations <br />for the Stewardship of Colorado Stream Corridors Fund, <br /> <br />Appropriates moneys from the general fund to the Stewardship of Colorado Stream <br />Corridors Fund, <br /> <br />SECTION 1. Article 60 of Title 37, Colorado Revised Statutes, is amended BY THE <br />ADDITION OF A NEW SECTION to read: <br /> <br />37-60-131. Stewardship of Colorado stream corridors - fund created, <br /> <br />(1) Legislative declaration. The general assembly hereby recognizes the importance of <br />rehabilitating and conserving the natural and beneficial values of Colorado's stream <br />corridors and floodplains and determines that the Colorado Department of Natural <br />Resources and the Colorado Water Conservation Board are responsible for the <br />development, implementation or approval of appropriate programs to address the <br />rehabilitation and preservation of stream corridors and floodplains, <br /> <br />SECTION 2. Section 37-60-131. Colorado water conservation board Stewardship of <br />Colorado Stream Corridors Fund -creation of -nature of fund - funds for <br />investigations - contributions. (1) (a) There is hereby created in the State Treasury a <br />fund to be known as the Colorado water conservation board Stewardship of Colorado <br />Stream Corridors Fund which shall consist of $20,000,000 appropriated thereto by the <br />general assembly to provide a source of funding to local governments to undertake <br />activities in Colorado's stream corridors which would improve and/or address flood <br />mitigation measures, streambank and channel erosion, loss of channel conveyance <br />capability, loss of wildlife habitat areas, loss of wetland areas, floodwater detention and <br />the prevention and control of floods, All interest earned from the investment of moneys <br />in the fund shall be credited to the fund and become a part thereof. Such fund shall be a <br />continuing fund to be expended in the manner specified and shall not revert to the general <br />fund of the state at the end of any fiscal year. <br /> <br />(b) Definition. As used in this article, unless the context otherwise requires: <br /> <br />(I) "Base Flood" means that flood event with a 100-year return frequency (one <br />percent chance in any given year); <br />(II) "Critical Facilities" means facilities necessary to maintain the health and safety of <br />the public in a community, except for public road systems; and (3) <br />(III) "Rehabilitation" means that the land will be returned to a form and productivity in <br />conformity with a prior land use or plan, including a stable ecological state that <br />does not contribute substantially to environment deterioration and is consistent <br />with surrounding aesthetic values, <br />
