<br />H. Michigan does not have sufficient staff to perform this function in <br />all cases. <br /> <br />I. Mississippi's law does not make provlslons for construction <br />inspection, per se, but they try to make an inspection after the dam <br />is built, if they classify it as High Hazard. <br /> <br />J. Montana exempts Federal owned or licensed and inspected dams, FERC <br />controlled, or having a Montana metal mine reclamation operating <br />permit. <br /> <br />K. Nevada reports that this function is not done for all dams. <br /> <br />L. North Dakota has an inspector present on the larger projects where <br />they cost share. On the smaller projects they have authority, but <br />little manpower. <br /> <br />M. South Dakota has statutory authority but seldom accomplishes. <br /> <br />N. Tennessee reports <br />Each project is <br />construction. <br /> <br />that this function is not done on a routine basis. <br />inspected approximately 1 or 2 times during <br /> <br />O. Vermont refers to its Dam Statute, 10VSA43, Section 1090. <br /> <br />P. Virginia has the right to inspect, but can cause the owner's engineer <br />to inspect the project. <br /> <br />Q. Washington performs as many inspections as their limited staff will <br />allow. <br /> <br />3. Upon completion oC construction, issue a permit to impound water. <br /> <br />35 states (70~) currently perform this function <br /> <br />Comments: <br /> <br />A. Arkansas issues the permit prior to construction. <br /> <br />B. Colorado does not issue a permit but authorizes storage in a letter to <br />the owner. <br /> <br />C. Connecticut has a certificate of approval indicating dam is safe, and <br />is issued after construction is completed and reservoir is full. <br /> <br />D. Florida has the authority to require pretty much what they feel is <br />necessary for new dams only. <br /> <br />E. Georgia does not issue a permit to impound water, but the operation <br />permit has special conditions which address impoundment of water. <br /> <br />F. Indiana' s permit is issued pr ior to construction for constructing the <br />dam and for the subsequent impounding of water. <br /> <br />-16- <br />
