WHEREAS, the following floodplains for which information is included in said new
report have aIready been designated and approved by the Colorado Water Conservation
Board:
SJCD 6100
Dutch Creek and Cook Creek
South Platte River

(FPR # 1 and # 15)

WHEREAS, the Town of Columbine Valley, Colorado, has requested the Colorado
Water Conservation Board to designate and approve the floodplains set forth in the
aforesaid new report; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the
Colorado Water Conservation Board to assist in the prevention of floods and flood damages
therefrom; and

WHEREAS, Sections 31-23-301 anc.l30-28-111, Colorado Revised Statutes, provide
that legislative bodies of local jurisdictions may provide zoning regulations for land uses on.
or along any storm or floodwater runoff channel or basin only after designation and
approval by the Colorado Water Conservation Board; and

WHEREAS, Sec..'tion37-60-106(1)( c), CoIoradoRevised Statutes, directs the Colorado
Water Conservation to designate and approve storm or floodwater runoff channels or basins
. and to make such designations available to legisIative bodies of local jurisdictions; and

WHEREAS, the detailed information in said new report relating to Dutch Creek and
SJCD 6100, meets all of the requirements for detailed information listed under the Board's
"Rules and Regulations for the Designatioj]. and Approval of Floodplains and of Storm or
Floodwater Runoff Channels in Colorado. (2 CCR 408-1); lmd

WHEREAS, the detailed information in said new report relating to the portion of
the South Platte River from the alignment of Fairway Lme in the Town of Columbine
Valley, as extended to the east, downstreanl to the northern corporate limit of the Town of
Columbine Valley as of April 17, 1989, does not meet all of the requirements for detailed
floodplain information listed under the Board's "Rules and Regulations for the Designation
and Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2
CCR 408-1) but does meet all the requirements for approximate floodplain information
listed under those Rules and Regulations; and

WHEREAS, it is appropriate that immediateIy before the adoption of this Resolution
the significance of the rescission of a portion of Floodplain Resolution No.1, the Colorado
Water Conservation Board's first Floodplain Resolution which has been in effect for over
25 years and which marked the beginning of an important phase in the history of the
Board's Floodplain Management Program, should be noted;
