4. The City end County shall require their contractor when

placing the landfill and riprap to provide, erect and maintain

warning signs and signals in accordance with directiona given by
the Division's District Engineer or his subordinate and shall take
necessary precautions for the protection of the ~ork and 'safety of
the public. If any portion of driving lanes are closed',flagmen will

be required and the traveling public must be protected during thiS

installation with -proper. warnings signs or signals both day and

night,
S, The City and County shall adviae the District Highway

Engineer in sufficient time before commencing and upon completion of

auch work,

6, The City end County shall use, occupy and maintain such work

on right of ~ay ~ith all reasonable diligence and precaution to avoid

damage to or obstruction of the high~ay or interferance ~ith high~ay

operation and maintenance.

7. No member of or delegate to Congress or Resident

Commissioner shall be admitted to any share or part of this agreement

or to any benefit that may arise herefrom, but this restriction shall.

not be construed to extend to this agreement if made with a

corporation or company for its general benefit.

8, The State ~arrants that no person or selling agency has been

employed to solicit or secure this agreement upon an agreement or

understanding for a commission, percentage, brokerage or contingent
fee, excepting bona fide employees or bona fide established commercial

or selling agencies maintained by the State for the purpose of

securing business. For breach of this warranty, the City and County

shall have the right to annul this agreement ~ithout liability.
9. This agreement shall be binding upon and inure. to the
benefit of the successors and assigns of the parties hereto.
