<br />CXlNDITIONS UNDER WHICH THE STATE OF CXlLORADO AGREES TO RIGHT OF ENTRY
<br />ONTO RIGHT OF WAY OF STATE HIGHWAY 160, ALAMOSA COUNTY, CXlLORADO

<br />This JOINT USE AGREEMENT, made and entered into this 19th day

<br />, 1987, between the City and County of Alamosa and
<br />
<br />their agencies. contractors and subcontractors, herein referred to
<br />
<br />as City and County and the STATE OF COLORADO, acting by and through
<br />
<br />The Department of Highways, herein referred to as the State.
<br />
<br />WITNESSETH, That:
<br />
<br />WHEREAS, extreme danger of flooding for the Rio Grande River is
<br />anticipated in accordance to studies completed by. the Army Corps of
<br />
<br />Engineers and othar agencies. The City end County is engagad in land
<br />
<br />surveying, taking soil samples and otherwise preparing ~or levee
<br />reconstruction or the removal of sediment, debris, vegetstion of any
<br />
<br />kind for flood control purposes of the Rio Grande River and upon land
<br />
<br />described to wit: I
<br />
<br />That portion of Block 42 in the Alamosa Subdivision, Section 10,
<br />I
<br />T 37N, R 10E, N.M.P.M., that lies within the Colorado. Department of
<br />
<br />Highways Right of Way for Highway 160 at the Bridge on the upstream
<br />
<br />side of the Rio Grande River.
<br />
<br />WHEREAS, the use of the highway right of way for the encroacment
<br />in the manner and under the conditions set forth in this JOINT USE
<br />if
<br />AGREEMENT will be compatible with the State's use of the right of
<br />
<br />way for operation and maintenance of said highway.
<br />
<br />
<br />NOW, THEREFORE, in consideration of the mutual be~efits and
<br />
<br />covenants herein contained, it is agreed as follows:
<br />
<br />1. The State agrees to Right of Entry onto its right of way by
<br />
<br />the City and County in the manner and under the conditions set forth
<br />
<br />in this JOINT USE AGREEMENT.
<br />
<br />2. The State or its assigns reserve the right to survey,
<br />
<br />construct, reconstruct, operate, maintain or remove said highway
<br />and its appurtenances.
<br />
<br />3. The City and County will survey, take soil samples,
<br />
<br />reconstruct, operate and maintain flood control levee, "and remove
<br />
<br />sediment, debris and vegetation for flood control without expense
<br />
<br />"
<br />
<br />to the State.
