<br />10 <br /> <br />Bids provided that they are then fully in conformance with <br />these Instructions to Bidders and the Bid Security is in an <br />amount sufficient for the Bid as modified or resubmitted. <br /> <br />13.02 If within twenty-four hours after Bids are opened, any <br />Bidder files a duly signed, written notice with the City and <br />promptly thereafter demonstrates to the reasonable <br />satisfaction of the City that there was a material and <br />substantial mistake in the preparation of his Bid, that <br />Bidder may withdraw his Bid and the Bid Security will be <br />returned. Thereafter, that Bidder will be disqualified from <br />further Bidding on the Work. <br /> <br />PART 14 - OPENING OF BIDS <br /> <br />14.01 Bids will be publicly opened, read aloud and tabulated <br />by the Project Manager or other City representative in the <br />Town Hall at the address referenced above. Bids <br />will be acted upon by the Crook Town Trustees wi thin <br />15 days from the opening of the Bids. An abstract of the <br />amounts of the Bids and major alternates will be made <br />available after the opening of the Bids. <br /> <br />PART 15 - BIDS TO REMAIN OPEN <br /> <br />15.01 Bids shall remain open the time specified on page one <br />of these Instructions after the date of the Bid opening, but <br />the City will, under other provisions stated in these <br />Instructions or may in its sole discretion, release any Bid <br />and return the Bid Security prior to that date. <br /> <br />PART 16 - AWARD OF CONTRACT OR CONTRACTS <br /> <br />16.01 The City reserves the right and discretion to reject <br />any and all Bids, to waive any and all informalities and to <br />negotiate Contract terms with the successful Bidder, and the <br />right to disregard all nonconforming, nonresponsive or <br />conditional Bids. Discrepancies between words and figures <br />will be resolved in favor of the words. Discrepancies <br />between the indicated sum of any column of figures and the <br />correct sum thereof shall be resolved in favor of the correct <br />sum. Your attention is called to the fact that proposals <br />that are not completed verbatim on the forms designated in <br />this Bid package are subject to immediate rejection in the <br />discretion of the City. <br /> <br />16.02 In evaluating Bids, the City shall consider the <br />qualifications of the Bidders, and whether or not the Bids <br />comply with the prescribed requirements. The City reserves <br />the right to reject the Bid of any Bidder who does not pass <br />any such evaluation to the City's satisfaction. The City may <br />accept Bids in any order or combination and may award each <br />section of the Work to different Bidders. <br />
