<br />WHEREAS, Wright Water Engineers, Inc., under contract to the UD&FCD
<br />completed in February 1986 a floodplain information report entitled "Major Drainagee
<br />Planning, Lower Ralston/Van Bibber and Leyden Creeks, Phase B Report, City of Arvada
<br />and Jefferson County"; and said report has not been approved and designated by CWCB,
<br />but a designation request is pending; and
<br />
<br />WHEREAS, a new report entitled "Flood Insurance Study, City of Aivadli; Colorado,
<br />Jefferson and Adams Counties," dated February 19, 1992, has been prepared by the Federal
<br />Emergency Management Agency; and
<br />
<br />WHEREAS, said new report includes detailed floodplain information for portions
<br />of Ralston Creek, Leyden Creek, Van Bibber Creek, and Clear Creek and approximate
<br />floodplain information for portions of Ralston Creek, Leyden Creek, little Dry Creek, little'
<br />Dry Creek Tributaries B and C, Bates Lake Drainage (Ralston Creek Tributaries A and B),
<br />and Clear Creek; and
<br />
<br />WHEREAS, the approximate floodplain information for those portions of said new
<br />report relating to the stream reaches for Ralston Creek, Leyden Creek, little Dry Creek,
<br />and Clear Creek, little Dry Creek Tributaries B and C; Bates Lake Drainageway and the
<br />detailed floodplain information for those portions of said new report relating to the stream
<br />reaches for Clear Creek within the corporate limits of the City of Arvada, Colorado, as of
<br />March 5, 1992, are consistent with the floodplain information previously designated by
<br />Resolution No. 55 on March 17, 1976; Resolution No. 94 on January 19, 1978; Resolution
<br />No. 123 on November 1, 1978; and Resolution No. 155 on January 30, 1980; and ,e
<br />
<br />WHEREAS, said new report provides more accurate and current information than
<br />the information contained in that portion of the floodplain report previously designated by
<br />Resolution No. 72 on July 27, 1977 relating to the reach of Van Bibber Creek from the
<br />confluence upstream to Ward Road (Corporate Areas Only), Resolution No. 92 on January
<br />19, 1978, relating to the reach of Ralston Creek from 56th Avenue upstream to Arvada
<br />Reservoir (Corporate Areas only), and the reach of Leyden Creek from its confluence
<br />upstream to Leyden Reservoir (Corporate Areas only); and
<br />
<br />WHEREAS, the City of Arvada, Colorado, has requested the Colorado Water
<br />Conservation Board to designate and approve the floodplains set forth in the aforesaid new
<br />report; and
<br />
<br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statues, requires the
<br />Colorado Water conservation Board to assist in the prevention of floods and flood damages
<br />therefrom; and
<br />
<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statues, provides
<br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on
<br />or along any storm or floodwater runoff channel or basin only after designation and
<br />approval by the Colorado Water Conservation Board; and
