Crowley <br />Chairman, Colorado Land Use Commission <br />1550 Lincoln Street <br />Denver, Colorado 80203 <br /> <br />Dear Mr. Crowley: <br /> <br />Marble Ski Area, Inc. has provided its complete cooperation to the Land <br />Use Commission in affecting remedial action regarding the five recommenda- <br />tions included in the Colorado Geological Survey Report dated July 23, 1973. <br />To this end meetings have been scheduled between our representatives and <br />members of your staff on the following dates: July 30, August 2 (at which time <br />John Andrews and Wilbert Ulman attended a detailed engineering seminar on <br />the slopes of Mt. Daly) August 13, and August 21, 1973. <br /> <br />Our purpose has been to take responsible action with the review and approval <br />of your agency so that deficiencies can be corrected without the necessity <br />of invoking your emergency powers. To this end, Charles J. Kelly, President <br />of Marble Ski Area, Inc., publicly announced at a meeting of the Gunnison <br />County Commissioners on August 7, 1973 that we have suspended land sales until <br />November 1, 1973. By that time we expect to have completed the necessary <br />reevaluation of presently filed plats to satisfy the reservations expres- <br />sed at the July 25, 1973 Land Use Commission meeting. <br /> <br />We understand that concern has been expressed over lots which have already <br />been sold where development could proceed despite the moratorium on sales. <br />We have examined the matter and found that no development of any kind can <br />proceed without the approval of the Marble Ski Area Association, Inc. <br />which is controlled by our corporation. Section 9.2 of the protective <br />covenants for Marble, which have been transmitted to your staff, provide. <br />that"No change in the existing state of property shall be made or permitted <br />without the prior written approval of the Association...." <br /> <br />A letter signed by the corporate officers of Marble is being forwarded to <br />you asserting that no development will be approved by the association <br />prior to November 1, without approval of your Commission and the State <br />Geologist. . <br /> <br />We would appreciate your written confirmation that these measures undertaken <br />voluntarily by the developer are sufficient to protect the public interest <br />and therefore, remove any necessity,on the part of the commission to exercise <br /> <br />MP..R8LE SKI AREA,INC. <br /> <br />MAR8~E' BOX 56C MARBLE STAR ROUTE 'CARBONDALE.
