<br />WHEREAS, said new report includes detailed floodplain information which is <br />consistent with the detailed floodplain information contained in Floodplain Resolution No. 133 <br />for the following stream reach, as listed in Table 1, attached hereto and by this reference <br />incorporated herein: <br /> <br />TABLE I <br /> <br />Detailed Information Which Is Consistent With <br />Previously Designated Detailed Information <br /> <br />Those portions of Cottonwood Creek that lie within the incorporated areas of the Town <br />of Buena Vista, as of March 30, 1982; and <br /> <br />WHEREAS, said new report includes approximate floodplain information for the <br />Arkansas River within the Town of Buena Vista; and <br /> <br />WHEREAS, the hydrology information for the approximate floodplain of the Arkansas <br />River in said new report has been prepared by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, the hydrology information for the Arkansas River has been estim"ten by <br />using available stream gage data and by performing a flood frequency analysis; and <br /> <br />WHEREAS, the IOO-year flows for the Arkansas River, both upstream and downstream <br />of its confluence with Cottonwood Creek, within the incorporated area of the Town of Buena <br />Vista have been presented in the said new supplemental report dated December 1996; and <br /> <br />WHEREAS, the Town of Buena Vista, Colorado has requested the Colorado Water <br />Conservation Board to designate and approve the floodplain information contained in said new <br />report; and <br /> <br />WHEREAS, the Town of Buena Vista, Colorado, has not requested the Colorado Water <br />Conservation Board to rescind any of the detailed floodplain information contained in <br />Resolution No. 133; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-1I1, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />2 <br />
