TITLE I - COST SHARING

Section 101. Harbors

A. Construction

1. Non-Federal interests pay during construction 10~ of the cost of
general navigation facilities (GNF) for increment to depth of 20
feet,

Non-Federal interests pay during construction 25~ of the cost of
GNF for increment greater than 20 feet to a depth of 45 feet.
Non-Federal interests pay during construction 50~ of the cost of
GNF for increment greater than 45 feet.

4. Additionally, non-Feds pay 10~ of. the cost of GNF over 30 years,
however, for each non-Federal dollar value of contributed lands,
easements, rights-of-way, relocations, and dredged material
disposal (LERRD), there will be a dollar credit against this 10~.

5. Non-Federal interests provide lands, easements, rights-of-way and
dredged material disposal.

6. Non-Federal interests perform all relocation of utilities except
in the case of a deep draft harbor or project constructed by
non-Federal interests in which case 1/2 of the cost of relocation
is borne by owner of utility.

B. Operation and Maintenance(O&M)

Federal government pays for 100~ of O&M except for deep-draft
harbors where non-Feds pay 50~ of incremental cost of O&M for that
portion of project with a depth greater than 45 feet,

C. Erosion or Shoaling Attributable to Federal Navigation Works

Costs of projects or measures to prevent or mitigate for erosion
and shoaling resulting from Federal navigation works will be cost
shared in same proportion as cost sharing provisions applicable
to navigation project. Non-Federal interests are required to
maintain such projects.
