<br />. <br /> <br />. <br /> <br />e <br /> <br />WHEREAS, Section 31-23-301 and 30-29-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, the said new report meets all of the requirements fOr detailed floodplain <br />information under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the Board finds that urimer County will use the following floodplain <br />information reports for the administration of their floodplain management program, which are: <br /> <br />o Flood Insurance Studies dated March 18, 1986, March 4, 1987, and November 17, <br />1993, respectively; <br /> <br />o Master Drainageway Planning Study, Cooper Slough, Boxelder Creek, City of Fort <br />Collins, Larimer County, dated August 1981; and <br /> <br />o Hydrologic Analysis of Cooper Slough within Larimer County, Colorado dated July <br />1993, by Love & Associates, Inc. <br /> <br />WHEREAS Larimer County officials have stated that they will regulate the Zone A <br />floodplains (approximate 100-year floodplains) for Cooper Slough, Coal Creek, Indian Creek and <br />Lower Boxelder Creek on a case-by-case basis, subject to a hydrologic and hydraulic investigation <br />by a professional engineer or equivalent; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Northglenn, Colorado, this 20th day of January, 1994 that it does <br />hereby designate and approve the detailed lOO-year floodplain as described by the water surface <br />elevations and profiles in said new report, dated November 17, 1993, for the appropriate study <br />reaches of the Cache La Poudre River and Boxelder Creek and does hereby rescind the <br />appropriate portions of Resolution Nos. 29, 53,205, and 272 within Larimer County, Colorado; and <br /> <br />BE IT FURTHER RESOLVED by the Colorado Water Conservation Board that it does <br />hereby designate as approximate floodplain information (Zone A) contained in said new report for <br />Cooper Slough, Coal Creek, Indian Creek and Lower Boxelder Creek on the condition that <br />Larimer County will regular these floodplains on a case-by-case through a hydrologic and hydraulic <br />review for any proposed development; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a <br />certified copy of this resolution to the Board of County Commissioners of Larimer County; City <br />of Fort Collins; the Colorado Office of Emergency Management; the Federal Emergency <br />Management Agency; and U.S. Army Corps of Engineers, Omaha District. <br /> <br />3 <br />
