<br />WHEREAS, a floodplain information report entitled "Flood Insurance Study, City of Loveland, , .. <br />Colorado" dated January 18, 1984 has been prepared by the Federal Emergency Management Agency; .. <br />and <br /> <br />WHEREAS, said report includes detailed floodplain information for those portions of the Big <br />Thompson River within the corporate limits of the Town of Loveland, as they ~ere in January 1984; <br />and <br /> <br />WHEREAS, the detailed floodplain information in said report dated January 1984 is not <br />consistent with the detailed floodplain information in the report previously designated by Resolution <br />Nos. 19 and 94-354.13; and <br /> <br />WHEREAS, the detailed floodplain information in said report dated January 1984 is consistent <br />with the detailed floodplain information in the report previously designated by Resolution No. 181; and <br /> <br />WHEREAS, the Town of Loveland, Colorado, has requested the Colorado Water Conservation <br />Board to designate and approve the floodplains ~et forth in said report; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />e <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in the report dated January 1984 meets all of the requirements for <br />detailed information listed under the Board's "Rules and Regulations for the Designation and Approval <br />of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in regular <br />meeting assembled in Breckemidge, Colorado, this 4th day of November, 1994, that it does hereby <br />designate and approve as detailed floodplain information the 1 DO-year floodplains as described by <br />floodwater surface elevations and profiles in said report, dated January 1984, and does hereby rescind <br />the detailed floodplain information for the Big Thompson River contained in Resolution Nos. 19 and <br />94-354.13; and <br /> <br />BE IT FURTHER RESOLVED that the Ooard does not rescind any portion of Resolution No. <br />181 adopted on December 4, 1981 and that it does hereby leave that resolution fully in effect; and <br /> <br />e <br /> <br />2 <br />
