<br />3 <br /> <br />Even though these structures are not included in an SFHA, they could be inundated by a flooding event <br />of greater magnitude tban the base flood. In fact, more than 25 percent of all losses in the NFIP occur <br />to structures located outside the SFHA in Zones B, C, or X. More than 25 percent of all policies <br />purchased under the NFIP protect structures located in these zones. This clearly illustrates that there is <br />a risk of flooding in non-SFHAs. That risk is just not as great as the flood risk to structures located in <br />SFHAs. To offer flood insurance protection to owners of such structures, the NFIP offers two types of <br />flood insurance. Property owners should discuss their individual flood risk situation and insurance needs <br />with their insurance agent or company before making a final decision regarding flood insurance coverage. <br /> <br />The revisions are effective as of the date of this letter; however, within 90 days of the second publication <br />in the Longmont Daily Times-Call, a citizen may request that FEMA reconsider the determination made <br />by this LOMR. Any request for reconsideration must be based on scientific or technical data. All <br />interested parties are on notice that, until the 90-day period elapses, the determination to modify the BFEs <br />presented in this LOMR may itself be modified. <br /> <br />Due to present funding constraints, we must limit the number of physical map revisions processed. <br />Consequently, we will not republish the FIRM and FIS report for your community to reflect the <br />modifications described in this LOMR at this time. However, when changes to FIRM Panel 0001 D and <br />the FIS report for your community warrant a physical revision and republication in the future, we will <br />incorporate the modifications described in this LOMR at that time. <br /> <br />The flood way is provided to your community as a tool to regulate floodplain development. Therefore, <br />the floodway modifications described in this letter, while acceptable to FEMA, must also be acceptable <br />to your community and adopted by appropriate community action, as specified in Paragraph 60.3(d) of <br />the NFIP regulations. <br /> <br />A separate LOMR was issued on the same date as this LOMR to describe the effects of this project on <br />the unincorporated areas of Weld County, Colorado. <br /> <br />This response to Mr. Krickbaum's request is based on mllllmum floodplain management criteria <br />established under the NFIP. Your community is responsible for approving all floodplain development, <br />including this request, and for ensuring that necessary permits required by Federal or State law have been <br />received. With knowledge of local conditions and in the interest of safety, State and community officials <br />may set higher standards for construction, or may limit development in floodplain areas. If the State of <br />Colorado or your community has adopted more restrictive or comprehensive floodplain management <br />criteria, these criteria take precedence. <br /> <br />The basis of this LOMR is, in whole or in part, a channel-modification/culvert project. NFIP regulations, <br />as cited in Paragraph 60.3(b)(7), require that communities assure that the flood-carrying capacity within <br />the altered or relocated portion of any watercourse is maintained. This provision is incorporated into your <br />community's existing floodplain management regulations. Consequently, the ultimate responsibility for <br />maintenance of the channel modification/culvert rests with your community. <br /> <br />The map panel as listed above and as revised by this letter will be used for all flood insurance policies <br />and renewals issued for your community. <br />
