<br />i <br /> <br />2 <br /> <br />The modifications are shown on the enclosed annotated copies of FIRM Panel 000 I D, Profile Panel 0 I P, <br />and the Floodway Data Table for Coal Creek. A copy of this notification is enclosed. Any request for reconsideration must <br />be based on scientific or technical data. In addition, a notice of changes will be published in the Federal <br />Register. <br /> <br />Because this LOMR will not be printed and distributed to primary users, such as local insurance agents <br />and mortgage lenders, your community will serve as a repository for these new data. We encourage you <br />to disseminate the information reflected by this LOMR throughout the community, so that interested <br />persons, such as property owners, local insurance agents, and mortgage lenders, may benefit from the <br />information. We also encourage you to prepare a related article for publication in your community's local <br />newspaper. This article should describe the assistance that officials of your community will give to <br />interested persons by providing these data and interpreting the NFIP maps. <br /> <br />Based on the modifications described above, the existing structures at 280 Evans Street, 365 Evans Street, <br />795 Briggs Street, 123 Cheesman Street, and 750 Pierce Street as shown on the topographic work map <br />entitled "Figure 4 - Sheet 6A of 6," prepared by WRC Engineering, Inc., dated May 1995, would not <br />be inundated by the base flood and are outside the SFHA. The structures are in Zone X (shaded), an area <br />of moderate flooding outside the SFHA. <br /> <br />If any current flood insurance policy issued under the NFIP covers a structure on this property and that <br />policy was required by the mortgage company in conjunction with Federal flood insurance requirements, <br />then flood insurance coverage is no longer required under the NFIP. <br /> <br />Accordingly, if a lender imposed the flood insurance requirement, that lender will have to determine <br />whether or not to continue that requirement. The lender may determine, as a business decision, that it <br />wishes to continue the flood insurance requirement in order to protect its collateral security on the loan. <br />If the lender decides to release the borrower from the flood insurance requirement, and the insured <br />decides to cancel the policy and seek a refund for the current policy year, the insured must obtain a <br />written waiver of the flood insurance requirement from the lender to provide to the property insurance <br />agent or company that is servicing their policy. The agent or company will then process the refund <br />request for the insured. <br />
