<br />the USGS publication entitled "Rainfall-Runoff Modeling and Regional Flood Characteristics <br />of Small Rural Watersheds in the Arkansas River Basin in Colorado"; and <br /> <br />WHEREAS, a procedure for determining hydrology information in Bent County for <br />approximate floodplains of the Arkansas River mainstem, streams with drainage areas less than <br />0.5 square miles or greater than 1125 square miles, lakes, ponds, local drainage areas, and <br />overflows from irrigation ditches and canals has not been established by the Guidelines for <br />Determining lOO-year Flows for Approximate Floodphzins; and <br /> <br />WHEREAS, the streams with drainage areas less than 0.5 square miles or greater than <br />1125 square miles, lakes, ponds, local drainage areas, and overflows from irrigation ditches and <br />canals may not be designated as approximate floodplain information without a procedure for <br />estimating loo-year peak flows, and the local government understands and agrees that a detailed <br />hydrologic and hydraulic study should be performed by a professional engineer and submitted <br />by the developer or the development proponent prior to any floodplain development in those <br />cases; and <br /> <br />WHEREAS, Bent County, Colorado has requested the Colorado Water Conservation <br />Board to designate and approve the approximate floodplain information set forth in Table 2; and <br /> <br />WHEREAS, Bent County, Colorado, has not requested the Colorado Water <br />Conservation to rescind any of the detailed floodplain information contained in Resolution No. <br />40; and <br /> <br />WHEREAS, Section 37-60-I06(I)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and-flood damages therefrom; <br />and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after designation and approval by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report with included mapping for said stream <br />reaches in Bent County, which have drainage areas greater than 0.5 square miles or less than <br />1125 square miles, meets all of the requirements for approximate information listed under the <br />Board's "Rules and Regulations for the Designation and Approval of Floodplains and of Stonn <br />or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />4 <br />
