<br />2 <br /> <br />PART II <br /> <br />TOWN OF MILLIKEN <br />DRAINAGE IMPROVEI1ENTS <br />LOLA PARK TRIBUTARY EXTENSION <br /> <br />INSTRUCTIONS TO BIDDERS <br /> <br />1. Contract Documents: The following comprise the Contract Documents. <br /> <br />a. Advertisement for Bids <br />b. Instructions to Bidders <br />c. Federal Wage Guidelines <br />d. Bid Bond <br />e. Addendums <br />f. Proposal Forms <br />g. Notice of Award <br />h. Agreement <br />i. Performance Bond <br />j. Notice to Proceed <br />k. General Conditions <br />1. Measurement and Payment <br />m. Detail and Technical Specifications <br />u. Drawings <br /> <br />Wherever the word "Contract" appears, it shall be held to include all <br />the above. <br /> <br />2. Bid: In filling out the bid form, Bidders shall be governed by the <br />following principles, Bids shall be made on the form provided. In <br />case of an error in calculation, the unit bid price shall govern. Prices <br />shall be typewritten or printed in ink. The Bid must be signed by an <br />authorized representative of the Bidder. The Owner reserves the right <br />to reject any or all Bids or accept only a portion of any Bid. <br /> <br />3. Bid Guaranty: Each Bid must be accompanied by a Performance Bond or <br />a certified check in the amount of five percent of the base Bid. Each <br />Bid shall be firm and binding upon the Bidder and the Bid Guaranty shall <br />be held by the Owner until such Bid is accepted or rejected. If the <br />successful Bidder fails to enter into a contract within five days of the <br />Notice of Award, the Owner shall be entitled to collect the amount of the <br />Bid Guaranty as liquidated damages. <br /> <br />4. Substitutions: If in the Drawings and Specifications, any material is <br />mentioned by a proprietary name, the Contractor may furnish any material <br />equal to that specified, if accepted in writing by the Engineer. The <br />Contractor shall be responsible for proof of equality. <br /> <br />5. Familiarization: Each Bidder shall be deemed to have made a careful <br />examination of the work site and the Contract Documents. Each Bidder <br />shall be familiar "ith all applicable federal, state, and local laws and <br />regulations which may affect the proposed work. There will be no financi.al <br />adjustment to any Contract award because of a lack of familiarization. <br />
