Box 25486, DFC <br />Denver, Colorado 80225 <br /> <br />RE: Environmental Assessment for the proposed acquisition and enhancement of <br />floodplain habitats along the upper Colorado, Green, and Gunnison Rivers <br /> <br />Dear Mr. Maddux; <br /> <br />Our staff completed a review of the draft Environmental Assessment (EA) for the above <br />referenced project last month, and I hope you can accept the following comments even <br />though they are late. The delay was not their fault! The CWCB would like to provide <br />you with several concerns/questions as a result of our review. The comments are <br />specifically related to the recommended solution as described in the EA (alternative 3) <br />which would "Protect and Enhance Flooded Bottomlands to Take Advantage of <br />Available Flows." We would appreciate a written response to the following comments if <br />the chosen alternative is to be implemented. <br /> <br />. <br /> <br />There is a general concern about the ability to protect eXlstmg public facilities, <br />infrastructure (roads, utilities, etc.), farmlands, homes, and other buildings in those <br />areas where lands and easements would be acquired for this project. Since future <br />flood control improvements would not be allowed on the acquired lands, how will <br />potential flood impacts to those existing features be mitigated? <br /> <br />A, <br /> <br />. <br /> <br />Will emergency flood control measures and flood fight efforts be allowed on the <br />acquired lands in cases when floodflows exceed the design discharges or exceed <br />existing levels of flood protection? <br /> <br />. <br /> <br />The breaching or removal of existing levees from acquired lands could have <br />significant adverse flood and erosion impacts on adjacent lands and facilities. It is <br />imperative that all necessary measures are taken to protect adjacent non-participating <br />landowners, and that those landowners are satisfied with their flood protection. <br />
