<br /> <br />Appendix 3-D: Excerpts from Colorado's Model Geologic Hazard Area Control Regulations. <br /> <br />The following model regulations for identification, designation, and control of <br />land use in areas of geologic hazard were prepared by the Colorado Geological Survey in <br />accordance with statutory charges contained in Colorado HB-l041. Whereas, at least to our <br />knowledge, comparable laws or regulations dealing with geologic hazard areas have never <br />been written, this has been a pioneer effort. However, since laws, regulations, and admin- <br />istrativc procedures for floodplain hazard areas have been developed and tested during <br />the past, they have drawn heavily upon the language of tested floodplain regulations in <br />drafting these model regulations. <br /> <br />WHEREAS, authority for the governing body of a municipality or a county to <br />adopt, amend, repeal, enforce and otherwise administer under the poliee power reasonable <br />Geologic Hazard Area Land Use Control Regulations and orders pertaining to land use <br />within the areas of its jurisdiction..., and <br /> <br />WHEREAS, the uncontrolled use of land within geologic hazard areas...adversely <br />affects the public health, safety and welfare of the citizens..., and <br /> <br />WHEREAS, the governing body...is empowered...to designate and administer areas <br />of state interest in a manner that will minimize significant hazards to public health and <br />safety or to property due to a geologic hazard, and <br /> <br />WHEREAS, geologic hazards are declared to be matters of state interest and are <br />defined...to include but not be limited to avalanches, landslides, rockfalls, mud flows, un- <br />stable or potentially unstable slopes, seismic effects, radioactivity and ground subsidence; <br /> <br />...NOW, THEREFORE, the Board of County Commissioners (City Council) does en- <br />act the following Geologic Hazard Area Control Regulation: <br /> <br />SECTION 1.0 PURPOSES <br /> <br />To promote the public health, safety and general welfare, to mInImize the effect of <br />significant hazards to public health and safety or to property due to a geologic hazard by <br />the proper administration of all land use changes within such geologic hazard areas, and <br />to promote wise use of geologic hazard areas. This Geologic Area Control Regulation has <br />been established with the following purposes intended: <br /> <br />1.1 To reduce the impact of geologic hazards to life and property by: <br /> <br />1.11 Prohibiting certain land uses... <br /> <br />1.12 Restricting the uses which would be hazardous... <br /> <br />1.13 Restricting the uses which are particularly vulnerable to geologic hazards so <br />as to alleviate hardship and reduce the demands for public expenditures for <br />relief and protection. <br /> <br />1.14 Restricting permitted land uses in geologic hazard areas, including public <br />facilities...to be protected...by providing for geOlogic hazard investigation <br />and avoidance or mitigation or hazard impacts at the time of construction. <br /> <br />C-19 <br />
