<br />. . <br /> <br />. <br /> <br />. <br /> <br />tributaries in the State of Colorado, which rights are adverse to and <br />jeopardize the rights of the United States and the Ute Mountain Ute <br />and Southern Ute Indian Tribes. All users of the aforementioned <br />waters are necessary parties to this action <br /> <br />~1HEREFORE, Plaintiff prays: <br /> <br />1. That each and all of the defendants be required to <br />appear before this court and set forth fully their claims in and to <br />the use of the waters of the Mancos, La Plata, Animas, Florida, Los <br />Pinos (Pine), Piedra, Navajo, and San Juan Rivers and waters tribu- <br />tary thereto in the State of Colorado. <br /> <br />2. That the court determine and decree that the United <br />States holds for the benefit of the Ute Mountain Ute Tribe of Indians <br />the right to divert and use so much of the waters of the Mancos and <br />San Juan Rivers and waters tributary thereto in the State of Colorado, <br />located on the Ute Mountain Ute Indian Reservation, as is or may <br />become reasonably necessary for the needs of said Ute Mountain Ute <br />Tribe of Indians, in fulfillment of the purposes for which the reser- <br />vation was created, and that such right be declared to have a priority <br />date of March 2, 1868. <br /> <br />3. That the court determine and decree that the United <br />States holds for the benefit of the Southern Ute Tribe of Indians <br />the right to divert and use so much of the waters of the La Plata, <br />Animas, Florida, Los Pinos (Pine), Piedra, San Juan and Navajo Rivers, <br />and waters tributary thereto in the State of Colorado, and located <br />on the Southern Ute Indian Reservation as is or may become reasonably <br />necessary for the needs of said Southern Ute Tribe of Indians, in <br />fulfillment of the purpose for which the reservation was created, and <br />that said rights be declared to have a priority date of March 2, 1868. <br /> <br />4. That the court determine and decree that the United <br />States has the right to the use of so much of the waters of the Mancos, <br />La Plata, Animas, Florida, Los Pinos {Pine}, Piedra, Navajo and San <br />Juan Rivers and waters tributary thereto in the State of Colorado, <br />in and on the San Juan National Forest lands within the watersheds <br />of the aforementioned rivers as is or may become reasonably necessary <br />for the needs and purposes of such National Forest lands, and that <br />such right be declared to have priority dates as of the dates these <br />lands were reserved for National Forest use. <br /> <br />5.
