Los Pinos (Pine), ) <br />Piedra, Navajo and San Juan Rivers ) <br />and waters tributary thereto in the ) <br />State of Colorado. ) <br />) <br />Defendants. ) <br /> <br />COP.1PIAINT <br /> <br />I. <br /> <br />This is a civil action in which the United States seeks to <br />have its rights and the rights of the Ute Mountain Ute and Southern <br />Ute Indian Tribes in and to the use of the waters of the Mancos, La <br />Plata, Animas, Florida. Los Pinos (Pine), Piedra, Navajo, and San Juan <br />Rivers and waters tributary thereto in the State of Colorado, deter- <br />mined and declared. The jurisdiction of this court is invoked under <br />Section 1345 of Title 28 of the United States Code. <br /> <br />II. <br /> <br />The members of the Ute Mountain Ute Indian Tribe live on <br />the Ute Mountain Ute Reservation, which is located in the southwest <br />corner of the State of Colorado. The present reservation was part of <br />a larger reservation which was withdrawn from the public domain and <br />reserved for the use of said Indian Tribe by the Ute Reservation <br />Treaty of ~arch 2, 1868. When said lands were reserved for Indian <br />use, waters in and on said lands were withdrawn from private appro- <br />priation as against the United States and reserved for use of the <br />Indian Tribe. The United States, on behalf of the Ute ~ountain Ute <br />Indian Tribe, claims rights in and to the use of the waters of the <br />
