<br />available to legislative bodies of cities and incorporated towns, to <br /> <br />county planning commissions, and to boards of adjustment of cities, <br /> <br />incorporated towns, and counties of the state." <br /> <br />The act further provides that after promulgation of guidelines for land <br />use in flood plains by the Colorado Water Conservation Board, the flood <br />plain shall be administered by local governments in a manner which is <br /> <br />consistent with the flood plain guidelines. <br /> <br />In 1974 the General Assembly added a new article 7 to chapter 106, <br /> <br /> <br />Colorado Revised Statutes 1963, (re-coded as article 65.1 of title 24, <br /> <br /> <br />C.R.S. 1973 [1975 Supp.]), relating to state and county planning com- <br /> <br /> <br />missions. This new article (H.B. 1041) provides for the designation and <br /> <br /> <br />regulation of areas and activities of "state interest." Section 24- <br /> <br /> <br />65.1-201, includes natural hazard areas, such as flood plains, as areas <br /> <br /> <br />of state interest. A flood plain is defined in the act as being "an <br /> <br /> <br />area adjacent to a stream, which area is subject to flooding as a result <br /> <br /> <br />of the occurrence of an intermediate regional flood ~ and which area <br /> <br /> <br />thus is so adverse to past, current, or foreseeable construction or land <br /> <br />use as to constitute a significant hazard to publ ic health and, safety or <br /> <br />Concerning the designation of flood plains, the Colorado Water Conser- <br /> <br /> <br />vation Board, acting in cooperation with the Colorado Soil Conservation <br /> <br /> <br />Board, is charged with the primary responsibility for <br /> <br />1. <br /> <br />Making recommendations to local governments and the Colorado <br /> <br />land -Use Comml ss Ion. <br /> <br />2. <br /> <br />Providing technical assistance to local governments. <br /> <br />Developmental Policies <br /> <br />to property." <br /> <br />With reference to the administration of flood plains, the act provides <br /> <br /> <br />that flood plains shall be administered so as to minimize significant <br /> <br /> <br />hazards to public health and safety or to property; open space activities <br /> <br /> <br />shall be encouraged; structures shall be designed in terms of use and <br /> <br /> <br />hazards; disposal sites and systems shall be protected from inundatiQn <br /> <br /> <br />by floodwaters; and activities shall be discouraged which, in time of <br /> <br /> <br />flooding, would create significant hazards to public health and safety <br /> <br />In the model flood plain regulations, adopted by the Colorado Water <br /> <br /> <br />Conservation Board, the statement of purpose is to promote the pUblic <br /> <br /> <br />health, safety and general welfare by provisions designed to: <br /> <br />1.
