<br />PART I <br /> <br />FLOODPLAIN MANAGEMENT I,EGISUWION <br /> <br />Federal and state governments have passed legislation to permit <br />the management of floodplains by federal agencies and local govern- <br />ments. The stat;utes enable: <br /> <br />a. the federal government to const,ruct flood control works <br />including dams and levees. <br /> <br />b. the federal government to provide federally subsidized <br />flood insurance to owners of property in flood-prone areas. <br /> <br />c. the federal government to control direct federal financial <br />assistance and loans through federally regulated lending institutions <br />for acquisition or construction of property :Ln flood-prone areas. <br /> <br />d. the Colorado Water Conservation Board to acquire land for <br />the purpose of the prevention or control of floods and flood control <br />projects authorized by the Cong:ress of the united States. <br /> <br />e. local governments to regulat.e '.18es in floodplains that have <br />been designated and approved by the ColoJ:ado WatE,r ConseJ:vation Board. <br /> <br />f. local government.s to regulat.e development in floodplains <br />t.hrough subdivision regula t.ions and building permits. <br /> <br />Federa,l J;,es.Js l",-~ive _.!iist<~:>:y <br /> <br />The federal government did not. specifically sponsor flood control <br />project.s until 1917 when the Congress passed the first. Flood Control <br />Act (33 U.S.C. 701-703). This act. appropriated federal funds spe- <br />cifically for flood control on the Mississippi and Sacramento Rivers. <br />The, Flood Control Act of 1936 (33 D.S.C. 701:' recognized the nat.ion- <br />wide federal responsibility for flood cont.rol on navigable rivers <br />and their t.ributaries. <br /> <br />Because of the rapid development of floodplains and the govern- <br />ment.'s desire to reduce flood losses, t.he Flood Control Act of 1960 <br />(33 D.S.C. 709a) was intended t.o begin a new trend in flood control. <br />This act stressed the need for flood hazard infoJ:mation and engineer- <br />ing advice to guide state and local government.s in planning and regu- <br />lating the use of flood-prone lands.
