<br />House Bill 1041 (1974) <br /> <br />Pursuant 1:0 the provisions of H.B.. 1041, (:24-65.1-101, et <br />seq., C.R.S. 1973 [1975 Supp.]), local gove:~nments may designate <br />certain areas of state interest from among ":he following: <br /> <br />a. Mineral resource areas. <br /> <br />b. Natural hazard areas. <br /> <br />c. Areas containing, or having a. significant impact upon, <br />historical, natural or archaeological resources of <br />statewide importance. <br /> <br />d. Areas around key facilities in which development may <br />have a material effect upon the facilii:y or the sur'- <br />rounding corrununity. <br /> <br />Among the natural hazards listed in the ac1: are floodplains. <br />A floodplain is defined in the act as being "an area. adjacent to a <br />st.ream, which area is subject to flooding as a l~esult o:E the occur- <br />rence of an int:ermediate regional flood and which area thus is so <br />adverse to past:, current, or foreseeable construction or land use <br />as to consti tut:e a significant hazard to public heal th and safety <br />or to property." <br /> <br />With reference to the administration 0:: floodplains, the act <br />provides that floodplains shall be administered so as to minimize <br />significant hazards to public health and safety or to property; open <br />space activities shall be encouraged; structures shall be designed <br />i.-; terms of use and hazar'ds; disposal sites and systems shall be <br />protected from inundation by floodwaters; and activities shall be <br />,jisc:ouraged which, in time of flooding, would c]~eate significant <br />ha,zards to public health and safety or to property. <br /> <br />The act further provides "that after promulqation o:E guidelines <br />fey "Land use in floodplains by the Colorado Wa"ter Conservation <br />Bad ;::1, the floodplain shall be adminis"t:ered by local governments in <br />a ,nanner which is consistent with the floodplain guidelines. <br /> <br />Concerning the designation of floodplains, the Colorado Water <br />Conservation Board, acting in cooperation with 1:he ColOl~ado Soil <br />Conservation Board, is charged with thE' prinary responsibility for <br /> <br />a. Making recommendations to local governments and the <br />Colorado Land Use Corrunission. <br /> <br />9 <br />
