<br />governments in order to assist local governffilomts in desi'-jnat:ing matter~;. <br />of state interest and adopting guidelinE!s fo:r the administration there... <br />of. <br /> <br />(2) (a) The department of local affair;3 sh,ill oversee and <br />coordinate the provision of technical assistance and provide financial <br />assistance as may be authorized by law. <br /> <br />(b) The department of local affail:s shall determine whether <br />technical or financial assistance or both are to be given to a local <br />government on the basis of the local government's: <br /> <br />(I) Showing that current or reasonably for'aseeable development <br />pre,ssures exist within the local government's ju.r isdiction; and <br /> <br />(II) Plan clescribing the proposed use of technical assista.nce <br />and expenditure of financial assistance.." <br /> <br />"24-65.1-407. Colorado land use cS?!!!Illis~ion may initiate identi- <br />fication, desiqnation, and promulqation.. of q.~.idelines for matters of <br />state interest. (1) (a) The Colorado land use commission may submit <br />a formal request: to a local government to ta:~.e action with regard to <br />a specific matter which said commission considers to be of state <br />int.erest within the local government's jUl:isdiction. Such .request <br />shall identify t:he specific matter and shall set fort:h the information <br />required in section 24-65.1-401 (2) (a) and (2) (b). Not later than <br />thirty days after receipt of such request, t:1.e local government shall <br />publish notice and hold a hear in'-j within sixty days pursuant: to the <br />provisions of section 24-65.1-404, and issue its order thereunder. <br /> <br />(b) Af:ter receipt by a local gove.enment of a request from the <br />Ce,lorado land use commission pursuant to paragraph (a) of this sub- <br />section (1), no person shall en'-ja'-je in development in the area or <br />conduct the activity specifically descJ:ibed in said request until the <br />:ocal government has held its hearing and iS3ued its order relating <br />Lr-.iereto .. <br /> <br />(e) If the local government's order fails to designate such <br />matLer and adopt guidelines therefor, or, after designation, fails to <br />adcpt guid'Blines therefor pursuant to st:anda.rds set forth in this <br />article applicahle to local governments, the Colorado land use commis- <br />sion may seek judicial review of such Ol:der or guidelines by a trial <br />de novo in the district court for the judicial district in which the <br />local government is located. During the pendency of such court pro- <br />ceedings, no pel:son shall engage in development in the a.rea or conduct <br />the activity specifically described in said request.
