<br />WHEREAS, the Federal Emergency Management Agency rescinded the said Flood Hazard <br />Boundary Map for the Town of Gilcrest on JUJ1e 10, 1980; and <br /> <br />e <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the Board is taking this action under the provisions of Rule 9.D.2. (Board Initiative) <br />and all affected communities have been notified and their comments have been considered in this <br />resolution; and <br /> <br />WHEREAS, the information on said Flood Hazard Boundary Maps, referenced above as Index <br />Nos. 94-357.01 and 94-357.02, does not meet all of the requirements for detailed or approximate <br />information listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in regular e <br />meeting assembled in Fort Morgan, Colorado, this 26th day of Miiy, 1994, that it does hereby rescind, <br />the 100-year floodplains as shown on said maps, referenced above as Index Nos. 94-357.01 and 94- <br />357.02, and does hereby leave in full force the designation and approval by the Colorado Water <br />Conservation Board contained in Resolution No. 43; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a certified <br />copy of this resolution to the Town of Starkville; the Town of Gilcrest; the Board of County <br />Commissioners of Las Animas County; the BDard of County Commissioners of Weld County; the <br />Colorado Office of Emergency Management; the U.S. Army Corps of Engineers, Albuquerque District; <br />and the Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a majority vote <br />of the members of the Colorado Water Conservation Board in regular session assembled at Fort Morgan, <br />Colorado, on the 26th day of May, 1994, at which a quorum was present. <br /> <br /> <br />~f:;d <br /> <br />e <br /> <br />Ipr357.brb <br /> <br />2 <br />
