William McDonald, Director <br />Flood Control and Floodplain Management <br />Colorado Water Conservation board <br />721 Centennial Building <br />1313 Sherman Street <br />Denver, CO 80203 <br /> <br />Section <br /> <br />Dear Mr. McDonald: <br /> <br />i' <br />,. <br />;) <br /> <br />Per your "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Storm or Floodwater Runoff Channels <br />in Colorado" dated December 11, 1987, an entity requesting a new <br />Designation or a revised designation of a floodplain must submit <br />their request in writing to the Colorado Water Conservation Board <br />at least 30 days prior to the next Board meeting. Rules 9 (0)(1) <br />and 10 clearly state this requirement. However, Rule 11 allows an <br />entity to request a variance for any part of Rules 1 through 10. <br />Therefore, the City of Westminster is requesting a variance for <br />Rules 9 (0)(1) and 10 with respect to the 30 day advance notice. <br /> <br />The primary reason that the City is requesting this variance <br />is because we are trying to accommodate the existing property <br />owners and allow them the flexibility of selling or developing <br />their land. It should also be pointed out that this variance does <br />not impact any structures and that all technical criteria used to <br />establish the revised floodplain elevations and designations are <br />in strict compliance with ali other aspects bf Rulec 9 and 10. <br /> <br /> <br />On Monday, March 14, 1988, the City delivered a copy of the <br />Report that was prepared for a portion of Big Dry Creek within the <br />City of Westminster just downstream of Standley Lake to the <br />Colorado Water Conservation Board. This Report, as prepared by <br />Wright Water Engineering, Inc., is a more detailed investigation <br />of the 100-year floodplain of that portion of Big Dry Creek just <br />upstream of the Colorado Southern Railroad. It takes into account <br />the routing and storage capabilities upstream of the railroad <br />within the adopted 1986 Flood Hazard Area Delineation (FHAD) <br />Floodway. The criteria and techniques utilized in the analysis <br />are acceptable to both the City of Westminster and the Urban <br /> <br />4800 West Ninety-Second Avenue. 80030 .
