Per your "Rules and Regulations for the Designation and
Approval of Floodplains and of Storm or Floodwater Runoff Channels
in Colorado" dated December 11, 1987, an entity requesting a new
Designation or a revised designation of a floodplain must submit
their request in writing to the Colorado Water Conservation Board
at least 30 days prior to the next Board meeting. Rules 9 (0)(1)
and 10 clearly state this requirement. However, Rule 11 allows an
entity to request a variance for any part of Rules 1 through 10.
Therefore, the City of Westminster is requesting a variance for
Rules 9 (0)(1) and 10 with respect to the 30 day advance notice.

The primary reason that the City is requesting this variance
is because we are trying to accommodate the existing property
owners and allow them the flexibility of selling or developing
their land. It should also be pointed out that this variance does
not impact any structures and that all technical criteria used to
establish the revised floodplain elevations and designations are
in strict compliance with ali other aspects bf Rulec 9 and 10.

On Monday, March 14, 1988, the City delivered a copy of the
Report that was prepared for a portion of Big Dry Creek within the
City of Westminster just downstream of Standley Lake to the
Colorado Water Conservation Board. This Report, as prepared by
Wright Water Engineering, Inc., is a more detailed investigation
of the 100-year floodplain of that portion of Big Dry Creek just
upstream of the Colorado Southern Railroad. It takes into account
the routing and storage capabilities upstream of the railroad
within the adopted 1986 Flood Hazard Area Delineation (FHAD)
Floodway. The criteria and techniques utilized in the analysis
are acceptable to both the City of Westminster and the Urban
