<br />Rule 9.0. For Hinor. Class III dams and all Class IV dams, the <br />owner shall provide an engineer experienced in dam design and con- <br />structio" who shall be responsible for the following: <br /> <br />9.0. (I) Notify the State Engineer of the start of construction: <br /> <br />9.0.(2) The engineer shall provide for the observation of the <br />construction and endeavor to guard against defects and deficiencies in <br />the construction of the dam and shall disapprove or reject work <br />failing to conform to the approved plans and specifications: <br /> <br />9.0.(3) Change orders shall be submitted in accordance with <br />Rule 9.A.(8): <br /> <br />9.0.(4) The engineer shall give the State Engineer It 1elst 10 <br />dlYs advlnce notice of their finll construction inspection: Ind <br /> <br />9.0.(5) The engineer shill notify the State Engineer of the <br />completion of the construction in Iccordance with Rule 10. <br /> <br />Rule 10. ApceDtance of Construction. Enlaroement. ,Alteration. <br />Modification or Rebair (Jurisdictional Dams}; <br /> <br />10.A. Construction for which application has been made pursuant to <br />Rule 5 or Rule 6 shall not be deemed complete nor shall storage of <br />water be permitted until the State Engineer furnishes to the owner a <br />written statement of acceptance, unless temporary approval of storage <br />is granted by the State Engineer. The acceptance shall specify the <br />vertical height, freeboard, length of the dam, the capacity of the <br />reservoir in ,atre-feet, and any limitation upon, or requirements for <br />the use of the dam. The State Engineer shall furnish the acceptance <br />or denial within 60 days of receipt of a complete notification of <br />completion. <br /> <br />10.B. The engineer shall provide written notification of completion <br />which shall include the following in order to be deemed complete: <br /> <br />10.8.(1) A written notification that the project is complete and <br />in general conforms with the approved plans, specifications and change <br />orders. <br /> <br />10.B.(2) The As-Constructed Plans which meet the requirements of <br />Rule S. <br /> <br />- 35 - <br />
