Gay III
Executive Director, Engineering Staff
DAEN-CWP-A
Pulaski Building, Room 7103
Washington, DC 20314

Dear Colonel Gay:

The Colorado Water Conservation Board provides you with our
specific concerns regarding the report entitled "Phase I, General
Design Memorandum, Fountain Creek," dated March 1981, as stated
in Governor Lamm's July 8, 1981, letter.

This office has been in communication with the Albuquerque
District Office during the project formulation process, and we
are in agreement with the project selected. However, we are
concerned that the Corps not forget that there remains upper
basin flooding prOblems and future study authorizations will be
requested.

The project has been proposed with two cost-sharing policies.
May I refer to them as the Current Federal ABC Requirements and
the Carter Administration's Five Percent state cash contribution.
This office desires to be advised under which pOlicy this project
will be authorized and funded for construction.

Fountain Creek has also been studied by the Federal Insurance
Administration under the National Flood Insurance Program. This
Board has performed reviews for both hydrologic and hydraulic
analyses. We are attempting to maintain consistency and unifor-
mity in the flood hazard parameters between the two programs. If
any changes are made in the hydrologic and hydraulic analyses
during study authorization and phase II engineering, we desire to
be advised and provided with appropriate technical write-ups.

With respect to the EIS on this proposed project, it appears
to us to be adequate. Based on the information in the final EIS
and our knowledge of the basin characteristics, it is anticipated
that the proposed plan of improvement for flood protection on
Fountain Creek will have few, if any, adverse environmental
impacts.

COLORADO WATER CONSERVATION BOARD, Frederick V. Kroeger, Chairman
Robert A. Jackson, Vice Chairman' John R. Fetcher, Steamboat Springs
C.M. Furneaux, Walden. Floyd L. Getz, Monte Vista' Patrick A.
