"Designated flood plain" means the area designated as a flood plain by <br />official action of the City Council with the prior concurrence _ of the <br />Colorado Water Conservation Board. <br /> <br />. <br /> <br />2. uFlood plainu means an area in and adjacent to a stream which area is <br />subject to flooding as the result of the occurence of an interm~diate regional <br />flood and which area thus is so adverse to past, current, or foreseeable <br />construction or land use as to constitute a significant hazard to public health <br />and safety or to property. <br /> <br />11-12-3: <br /> <br />USE OF DESIGNATED FLOOD PLAINS: <br /> <br />. <br /> <br />(A) No development, use, fill, construction or alteration on or over any portion <br />of a designated flood plain shall be permitted which would cause or result in <br />any of the following: <br /> <br />. <br /> <br />3, "Intermediate regional flood" means a type of flood, including the water <br />surface elevation and territorial occupation thereof, which can be expected <br />to OCCur at any time in a given area based upon recorded historical <br />precipitation and other valid data, but with an average statistical one percent <br />(1%) chance of being equalled or exceeded during anyone year, The term is <br />used interchangeably with a one percent (1 %) flood or hundred year flood. <br /> <br />4. uLow hazard zoneu means that area of the flood plain 'in which the <br />waters of an intermediate regional flood will not either attain a depth greater <br />than one foot 11') or reach a velocity greater than three feet (3') per second, <br /> <br />5. "'Stream" means any natural channel or depression through which water <br />f1a~ . either . ~ont.inuously, intermittently ar periodically, including any <br />artifiCial modification of the natural channel or depression. <br /> <br />1. The storage or processing of materials that in times of flooding are <br />buoyant, flammable, explosive or otherwise potentially injurious to human, <br />animal or plant life. <br /> <br />. <br /> <br />2, The disposal of garbage or other solid waste materials, <br /> <br />3. The human occupation of structures, either fixed or mobile, for <br />residential purposes, either permanent or temporary. <br /> <br />. <br /> <br />4. Substantial solid debris being carried downstream by floodwaters, <br /> <br />5. Any obstruction which would impair the flow capacity of a designated <br />flood plain so as to cause foreseeable damage to others, wherever located. <br /> <br />. <br /> <br />. <br /> <br />11-12-2: DESIGNATION OF FLOOD PLAINS: The flood plains of the City <br />. of. Westmin~ter are hereby defined as encompassing all t~ose land <br />are~ of the CIty in and ad)acem to a stream which lies within the area which would <br />be mundated by an intermediate regional flood as heretofore or hereafter approved <br />by the, Colorado Water Conservation Board; which streams are those known as <br />Woman s Cr,eek, Walnut Creek. Big Dry Creek, Little Dry Creek, and Shaw Heights <br />Branch of Little Dry Creek, <br /> <br />(B) Except as prohibited heretofore, the low hazard zone of a designated flood <br />plain, if the low hazard zone has been identified, may be used for any lawful <br />purpose; provided that: <br /> <br />. <br /> <br />1. Such use shall not cause a measureable enlargement of the flood plain on <br />lands other than those owned by the user, <br /> <br />. <br /> <br />IA) True and official copies of maps of flood plains so designated by the City <br />Coun~11 shall be kept and maintained for public inspec1ion in the offices of <br />the City Engineer. Such maps shall be in sufficient detail and scale so as to <br />permit ready identification of the flood hazard area, including the low <br />hazard area, ii any, by ground inspection or survey. <br /> <br />2. Any building or structure, whether fixed or mobile, designed for human <br />occupancy or the storage of property, and occupying a space greater than <br />one hundred (100) square feet, shall be constructed or located so that any <br />ex'ernal wall shall be not less than fifteen feet (15') from the inner boundary <br />of the low hazard zone. <br /> <br />. <br /> <br />3, The lower floor of any such building or structure shall be not less than <br />one foot (1') above the maximum water elevation of the computed <br />intermediate regional flood. <br /> <br />. <br /> <br />. <br /> <br />
