<br />SECTION 1. STATUTORY AUTHORIZATION, LEGISLAIIVE DECLARATION, FINDINGS
<br />OF FACT, AND PURPOSE
<br />
<br />1,01 Statutory Authorization, This O"djnance fol' tlood prevention and
<br />control is adopted pursuant to the autho~ity contained in Section
<br />139-60'-1, Colorado Revised Statutes, as amended,
<br />1,02 Findings of Fact. The City Council finds that there are within the
<br />City of Broomfield various flood plains constituting natural hazards
<br />of state and local .nterest, the occupation of which is likely to
<br />cause the loss of human life and the destructlon of property, and
<br />that the imprudent occupation of these flood plains will pose a
<br />continuing and greater future danger to life and property, unless
<br />proper regulations are adopted concerning their use and occupation.
<br />1.03 Legislative Declaration - Purpose. The pUl'pose of this Ordinance
<br />is to promote the publlC health, safety, and general welfare, to
<br />minimize flood losses in areas subject to flood hazards, and to promote
<br />wi se use of the flood pi a in. Thi s fl ood pIa i n Ordi nance has been
<br />established with the following purposes intended:
<br />(a) To reduce the hazard of floods to life and property by:
<br />(1) Prohibiting uses which are dangerous to life or property
<br />and/or which are hazardous to the public in time of flood;
<br />(2) Restricting uses which are particularly susceptible to
<br />flood damage, so as to alleviate hardship and eliminate
<br />demands for p;b 1 i c expenditures for rel ief and protecti on;
<br />and
<br />(3) Requiring permitted flood plain uses, including public
<br />facilities which serve such uses, to be protected
<br />against floods by providing flood proofing and general
<br />floo~' protection at the time of initial construction.
<br />(b) To alert flood plain occupants or potential occupants to flood
<br />hazards and which is or may be undertake~without full realization
<br />of the danger by:
<br />(1) Regulating the manner in WhiCh structures designed for
<br />human occupancy may be constructed;
<br />(2) Regulating the method of construction of water supply,
<br />sanitation systems and other utilities, so as to prevent
<br />disease, contamination and ur.sanitary conditions; and
<br />(3) Delineating and describing areas that could be inundated
<br />by floods so as to protect individuals from purchasing
<br />flood plain lands foy' purposes ,..hich are not in fact
<br />sui table,
<br />(el To protect the pUblic from the burden of avoidable financial
<br />expenditures for flood contl'oi and rel1ef by not regulating all
<br />uses I'lithin the flood plain areas 50 as to produce a method of
<br />construction and a pattern of development which will minimize the
<br />pro~ability of damage to property and loss of life or injury to
<br />the inhabitants or the flood hazard areas.

<br />SECTION 2 GENEP~L PROvISiONS
<br />
<br />2.01 Jurisdiction: The jurisdiction of this section includes all lands
<br />adjacent to or wi thi n any watercoUf'se wi tl\ 1 n the Ci ty that would be
<br />inundated by the lOO-year flood.
<br />2.02 District Types: The Flood RegulatGfj Disvict cover's the 100-year
<br />flood pl a in, Where deemed to be in tne pub 11 c i nteres t by the City,
<br />and to promote wise use of the flood plaln, the Flood Regulatory
<br />District may be subdivided into the Floodway District and the Flood
<br />Storage District.
<br />The Flood Regulatof'Y District is deflned by computing the lOO-yeat"
<br />flood plain limits under' existing channel and flood plaIn conditions.
<br />The Floodway District for the purpose of subdlViding the Flood Regulatory
<br />District is defined as that portlon of the Flood Regulatory District that
<br />woul d remai n assumi n9 an equal deg.'ee of encroachment extendi ng for
<br />a significant reach on both sides of the stream and causing no more
<br />than a one-half foot rise 111 the 100'}6a" flood water surface profile
<br />or that port;on of the Flood Reguli'tc"^j Di5trict that would remain
<br />after exclud\ng those outside po't1or.s of the F100d Regulatory
<br />District \1her'e the depth of fiew for the iOO-year flood is less than
<br />2 feet or the surface flo~ velo(1ty j5 less than 3 feet per second
<br />whichever criteria would assume the least encroachl'1ent on the flood
<br />plain.
<br />The subdwision of the Flood RE-gu1"to"y Distnet and accompanying
<br />hydr'aulic studies must be based open a1! cf '(he Flood Storage District
<br />reach being filled. Creation of the F10cdway D1strict and Flood Storage
