<br /> <br />C.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, said Flood Insurance Study dated May 21,2001 revises previous versions of the <br />La Plata County PIS to incorporate detailed flood hazard information for the stream reaches as listed in <br />Table 3 within La Plata County: <br /> <br />Table 3 <br />Revised Floodplain Information <br /> <br />Stream Name <br />Animas River <br /> <br />Revised Reach <br />2.09 miles dowstream of U.S. Highway 155/160 to 039 miles of <br />Posta Road <br />0.58 miles to 3.56 miles u stream of 32" Street <br />Confluence with Animas River to 3,525 feet upstream of U <br />Highwa 160 <br /> <br />Animas River <br />Lightner Creek <br /> <br />WHEREAS, the detailed floodplain information, as listed in Table 3, in said new Floodplain <br />Information Report and Hydrology Addendum with included maps, meets all ofthe requirements listed <br />under the Board's "Rules and Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the detailed and approximate floodplain information, as listed in Tables I and 2, <br />in said new Floodplain Information Report and Hydrology Addendum has already been designated by <br />the CWCB via floodplain resolution number 01-529; and <br /> <br />WHEREAS, a procedure for determining hydrology information in La Plata County for <br />approximate floodplains of reservoirs, lakes, ponds, local storm drainage areas, and overflows from <br />irrigation ditches and canals has not been established by the CWCB; and those floodplain areas may <br />not be designated as approximate floodplain information without a procedure for estimating 100- <br />year peak flows, and therefore the local government should require that a detailed hydrologic and <br /> <br />3 <br />
