SECTION 40: F-P FLOOD PLAIN OVERLAY DISTRICT i A. INTENT AND PURPOSE B. This district is intended to promote the p~blic health, safety and general ~Ielfare of the citize'ns of Jefferson County, minimize the risk of loss of li:e and property in areas subject to flooding; encourage pr~dent land use in the flood plain; permit only such uses within the flood plain as will not increase the danger to health, safety and property in times of flooding; re- gulate uses so as to control flood heights and velocities;' reQulate construction of structures and facilities per- mitted in the flood plain; protect by flood proofing buildings and structures so as to mini~ize risk of disease, contamination and unsanitary conditions during times of flooding; protect the public fron avoidable and reoccurring public expenditures due to flood dareage; protect the hydraulic characteristics 0: wate~ courses. (orig. 1-10-75; am. 2-11-80) GENERAL PROVISIONS A~O RESTRICTIONS 1. Flood Plain District Overlays the O~he~ Zone Districts, The Flood Pl~in Ove~l3Y District s~ell overlay that portion of any other zone district, i~~l~ding Planncd- Development (P-D) Zone District, loca~cc in the flood p13in. The regulations of this district shall be construed as being supple~entary to ttc regulations imposed on the same lands by any underlying zone district. When regulations of this district con- flict with any provision of the uncerlying zone district, the provisions of the Flooe plain Overlay District shall control; otherwise, the p~ovisions of any underlying zone district shall re~ain in full force and effect. (orig. 1-10-75; a:Tl. 2-11-80) 2. 8oundaries: The Flood Plain Overlay District shall enco~pass the 100 year Flood Plain as it gra?~ically appears on duly adopted Special Flood Plain l.:":?s. Flood Plain Overlay zone District bounda~ies ~ay be amended through the County's rezoning process when appropriate. (orig. 1-10-75; am. 2-11-80) -47- February 11, 1980 3. Low and High Hazard Areas: Where applicable, each Flood Plain Overlay District shall consist of 2 hazard areas. The "hisrh haz.lI:d .:>rea" shall be that portion of the Flood Plain Overlay District wherein the water, during a lao year flood, would exceed 1 foot in depth or 3 feet per second in velocity. The "low hazar-d area" shall be that portion of the Flood plain Overlay District not included within the high hazard area. (orig. 2-11-80) 4 . Restrictions: Unless authorized under the provisions of Paragraphs C. or D. below, the following restrictions shall apply to activities or uses within the Flood Plain Overlay District: (orig. 2-11-80) a. No structure(s), building(s), trailer(s), mobile horne(s), road(s), bridge(s), fencers) (except barbed wire fences), fill material(s), junk, refuse, solid waste disposal facility(s), or other obstruction(s) shall be placed, con- structed, stored or be located in this district. No storage or processing of materials or . substances that are poisonous, buoyant, flam- mable, exnlnBiv"., or that. cnn"titut.e " ""h- stantial threat of injury to human, animal or plant life during a flood, shall be permitted. (orig. 1-10-75) c. ~o land use activity which materially changes the location, elevation, or hydraulic char- acteristics of the existing 100 Year Flood Plain shall be permitted. ";..dJillon<ll Restrict.iol1s: In addition to those restrictions set forth in Paragraph B.4 above, no structure and/or trailer or mobile home, whether temporary or permanent, designed for human occupancy shall be placed in a high hazard area.
