<br />SECTION 40: F-P FLOOD PLAIN OVERLAY DISTRICT <br /> <br />i <br /> <br />A. <br /> <br />INTENT AND PURPOSE <br /> <br />B. <br /> <br />This district is intended to promote the p~blic health, <br />safety and general ~Ielfare of the citize'ns of Jefferson <br />County, minimize the risk of loss of li:e and property <br />in areas subject to flooding; encourage pr~dent land <br />use in the flood plain; permit only such uses within <br />the flood plain as will not increase the danger to <br />health, safety and property in times of flooding; re- <br />gulate uses so as to control flood heights and velocities;' <br />reQulate construction of structures and facilities per- <br />mitted in the flood plain; protect by flood proofing <br />buildings and structures so as to mini~ize risk of <br />disease, contamination and unsanitary conditions during <br />times of flooding; protect the public fron avoidable <br />and reoccurring public expenditures due to flood dareage; <br />protect the hydraulic characteristics 0: wate~ courses. <br />(orig. 1-10-75; am. 2-11-80) <br />GENERAL PROVISIONS A~O RESTRICTIONS <br /> <br />1. Flood Plain District Overlays the O~he~ Zone Districts, <br />The Flood Pl~in Ove~l3Y District s~ell overlay that <br />portion of any other zone district, i~~l~ding Planncd- <br />Development (P-D) Zone District, loca~cc in the flood <br />p13in. The regulations of this district shall be <br />construed as being supple~entary to ttc regulations <br />imposed on the same lands by any underlying zone <br />district. When regulations of this district con- <br />flict with any provision of the uncerlying zone <br />district, the provisions of the Flooe plain Overlay <br />District shall control; otherwise, the p~ovisions <br />of any underlying zone district shall re~ain in <br />full force and effect. (orig. 1-10-75; a:Tl. 2-11-80) <br /> <br />2. 8oundaries: <br /> <br />The Flood Plain Overlay District shall enco~pass <br />the 100 year Flood Plain as it gra?~ically appears <br />on duly adopted Special Flood Plain l.:":?s. Flood <br />Plain Overlay zone District bounda~ies ~ay be <br />amended through the County's rezoning process when <br />appropriate. (orig. 1-10-75; am. 2-11-80) <br /> <br />-47- <br /> <br />February 11, 1980 <br /> <br />3. <br /> <br />Low and High Hazard Areas: <br />Where applicable, each Flood Plain Overlay District <br />shall consist of 2 hazard areas. The "hisrh haz.lI:d <br />.:>rea" shall be that portion of the Flood Plain <br />Overlay District wherein the water, during a lao <br />year flood, would exceed 1 foot in depth or 3 <br />feet per second in velocity. The "low hazar-d area" <br />shall be that portion of the Flood plain Overlay <br />District not included within the high hazard area. <br />(orig. 2-11-80) <br /> <br />4 . <br /> <br />Restrictions: <br /> <br />Unless authorized under the provisions of Paragraphs <br />C. or D. below, the following restrictions shall <br />apply to activities or uses within the Flood Plain <br />Overlay District: (orig. 2-11-80) <br />a. No structure(s), building(s), trailer(s), <br />mobile horne(s), road(s), bridge(s), fencers) <br />(except barbed wire fences), fill material(s), <br />junk, refuse, solid waste disposal facility(s), <br />or other obstruction(s) shall be placed, con- <br />structed, stored or be located in this district. <br />(orig. 1-10-75; a~. 2-11-80) <br /> <br />b. No storage or processing of materials or . <br />substances that are poisonous, buoyant, flam- <br />mable, exnlnBiv"., or that. cnn"titut.e " ""h- <br />stantial threat of injury to human, animal or <br />plant life during a flood, shall be permitted. <br />(orig. 1-10-75) <br /> <br />c. ~o land use activity which materially changes <br />the location, elevation, or hydraulic char- <br />acteristics of the existing 100 Year Flood <br />Plain shall be permitted. (orig. 1-10-75; am. <br />2-11-80) <br /> <br />5. <br /> <br />";..dJillon<ll Restrict.iol1s: <br /> <br />In addition to those restrictions set forth in <br />Paragraph B.4 above, no structure and/or trailer <br />or mobile home, whether temporary or permanent, <br />designed for human occupancy shall be placed in a <br />high hazard area.
