<br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the floodplain information ill said report for West Fork Clear Creek, Lion <br />Creek, and Bard Creek in the City of Empire does not meet all of the requirements for detailed <br />information listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1), due to <br />missing or unavailble technical backup data; and <br /> <br />WHEREAS, the floodplain information in said report may be designated as approximate <br />floodplain information under the Board's "Rules and Regulations for the Designation and Approval <br />of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1). <br /> <br />DESIGNATION AND APPROVAL ACTION <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Denver, Colorado, this 21st day of July 1997, that it does hereby <br />designate and approve as approximate floodplain information those portions of West Clear Creek, <br />Lion Creek, and Bard Creek within the City of Empire as described in said report dated June 1976; <br />and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a <br />certified copy of this resolution to the City of Empire; the Board of County Commissioners of Clear <br />Creek County; the Colorado Office of Emergency Management; the u.S. Army Corps of Engineers, <br />Omaha District; and the Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a majority <br />vote of the members of the Colorado Water Conservation Board in regular session assembled at <br />Denver, Colorado, on the 21st day of July 1997, at which a quorum was p'resent. <br /> <br /> <br />~~~4 <br /> <br />res-459.doc twb <br /> <br />2 <br />
