RESOLUTION

STUDY TO BE DESIGNATED

WHEREAS, the Federal Insurance Administration completed a floodplain information
report entitled "Flood Insurance Study, City of Empire, Clear Creek County, Colorado" dated June
1976; and

WHEREAS, said report includes detailed hydrology and floodplain delineations for West
Fork Clear Creek, Lion Creek, and Bard Creek, within the incorporated portions of Empire, as they
were on June 1976; and

FLOODPLAIN CONSISTENCY

WHEREAS, the detailed floodplain information contained in said report is reasonably
consistent with the approximate information contained in the "Flood Insurance Rate Map, Clear
Creek County, Colorado, Unincorporated Areas," dated March II, 1980; and

LOCAL REQUEST FOR DESIGNATION

WHEREAS, the City of Empire, Colorlldo has been notified of the Colorado Water
Conservation Board's initiative to designate and Ilpprove the floodplain information contained in
said report; and

C.R.s AUTHORITY

WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, requires the Colorado
Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that
legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along
any storrn or floodwater runoff channel or basin only after designation and approval by the
Colorado Water Conservation Board; and
