AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff charmel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff charmels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the detailed floodplain information, as listed in Table I, in said new Floodplain <br />Information Report and Hydrology Addendum with included maps, meets all of the requirements listed <br />under the Board's "Rules llIld Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Charmels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the approximate riverine floodplain information, as listed in Table 2, in said new <br />Floodplain Information Report llIld Hydrology Addendum with included maps meets all of the <br />requirements listed under the Board's "Rilles and Regulations for the Designation and Approval of <br />Floodplains llIld of Storm or Floodwater RunoffCharmels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, 100-year peak discharges within La Plata County for the streams listed in Table 2 <br />(except for the Los Pinos River llIld Animas River) were developed by the consulting firm of <br />Montgomery Watson utilizing the latest availiible CWCB regional regression equations entitled <br />"Guidelines for Determining 100-year Flood FloWS for Approximate Floodplain in Colorado"; and <br /> <br />WHEREAS, the peak flow values for the Los Pinos River, as presented in said new Hydrology <br />Addendum, were obtained from a draft hydrolOgy report by the U.S. Army Corps of Engineers, <br />Albuquerque District, that was not officially published at the time of this designation, but which had <br />been previously accepted by local, state, and federal government floodplain officials; llIld <br /> <br />WHEREAS, a procedure for determining hydrology information in La Plata County for <br />approximate floodplains of reservoirs, lakes, ponds, local storm drainage areas, and overflows from <br />irrigation ditches and canals has not been establisl:1ed by the CWCB; and those floodplain areas may <br />not be designated as approximate floodplain information without a procedure for estimating 100- <br />year peak flows, llIld therefore the local govemrt1ent should require that a detailed hydrologic and <br />hydraulic study be performed by a professional engineer and submitted by the developer or the <br />development proponent prior to any floodplain development in those cases; and <br /> <br />3 <br />
