Love & Associates <br />2995 Centergreen Court South <br />Suite C <br />Boulder, Colorado 80301 <br /> <br />Re: Dutch Creek <br /> <br />Dear Craig: <br /> <br />As a follow-up to our conversation this week regarding maintenance <br />of the subject improvements through Columbine Val1ey, let me respond to <br />your question of maintenance responsibility by the following which will <br />be included as part of the Interagency Agreement to be executed by the <br />District and the Town of Columbine Valley. This agreement will be <br />signed by the parties prior to construction of the improvements and will <br />inc1ude the following: <br /> <br />OWNERSHIP AND MAINTENANCE <br /> <br />The parties agree that CITY shall own and be responsible for <br />maintenance of the completed facilities and rights-of-way acquired by <br />virtue of this Agreement. The parties further agree that DISTRICT shall <br />assist CITY with the maintenance of all facilities constructed or <br />modified by virtue of the Agreement to the extent possible depending on <br />availability of DISTRICT funds. Such maintenance assistance by DISTRICT <br />shall be limited to drainage and flood contr01 features of the project. <br />The specific nature and terms of the maintenance assistance shall be set <br />forth in writing by DISTRICT fo1lowing completion of the project. <br />Maintenance assistance may include activities such as keeping flow areas <br />free and clear of debris and si1t, cutting and controlling grass and <br />weeds in the channel right-of-way, keeping culverts free of debris and <br />sediment, repairing drainage and flood contro1 structures such as drop <br />structures and energy dissipators, repairing eroded sections of channe1 <br />and drainage right-of-way, and c1ean-up measures after periods of heavy <br />runoff. <br /> <br />The DISTRICT shall have right-of-access to right-of-way at all <br />times for observation of flood control facility conditions and for <br />maintenance when funds are available. <br /> <br />It is understood that if the CITY abandons this project as <br />constructed at any time, the DISTRICT's share of the construction funds <br />
