Bassi ~ . <br />Assistant Attorney General <br /> <br />TO: <br /> <br />RE: <br /> <br />Suggestions for Letter to Applicants for South Platte <br />Channelization Project Easements <br /> <br />Last week, you inquired whether the CWCB can send letters to <br />the applicants for South Platte Channelization Project easements to <br />notify them that the Board has granted initial approval of those <br />easements, and what should be included in such letters. I suggest <br />sending these letters and including requests for any necessary <br />information for drafting the easement documents in the letters. I <br />also recommend the following for each letter: <br /> <br />1. Inform the applicant that the Board has granted "initial <br />approval" of the easements, subject to several conditions, <br />which "include, but are not limited to," the following: <br /> <br />A. The use of the easement must be compatible with the <br />purpose of the flood control project. <br /> <br />B. The use of the easement cannot interfere with or increase <br />the State's costs of any operational or maintenance <br />activities of the flood control project. <br />
