Your description is too <br />vague to determine if an easement or an intergovernmental <br />memorandum of agreement is required. If you will provide <br />me with the specific details in writing, the appropriate <br />documents can be drafted. <br /> <br />Both the City of Littleton and CDOT have construction projects <br />in this area. Their right-of-way people may be able to <br />provide you with the fair market value of the easements <br />requested. If not, the Board may need to obtain an appraisal <br />or other acceptable determination of the value of the ease- <br />ments requested. <br /> <br />2. Storm drainage easements: <br /> <br />This type of easement request has a different legal <br />analysis. This will be covered in the attorney-client <br />memo to the Board. Once the Board determines how it <br />wishes to proceed in this area, the appropriate docu- <br />ments, if necessary, can be prepared. The following <br />requests are covered: <br /> <br />a. Wiggins & Ackerman culvert (#1) <br /> <br />b. Federal Express weir (#4) <br /> <br />c. Waste Management, Inc. culvert (#5). We recommend <br />that you check with the Colorado Department of Health and <br />any appropriate local entities to determine if all of <br />these entities requesting easements: <br /> <br />1) have all necessary permits <br /> <br />2) are in compliance with all necessary permits <br /> <br />3) are involved in or have been involved in any <br />proceedings for violations of any such permits or <br />
