..... ~
.,

.

.

Larry Lang
Page 2

CONFIDENTIAL

circumstances, etc., I can prepare a draft easement for
the Board's consideration.

b. Request from Urban Drainage & Flood Control District
and the Town of Columbine Valley (#8) for temporary
construction easements for their Dutch Creek channeliza-
tion project. Some additional easements are also needed
for this project. Again, if you will provide me with the
specific information in writing, I will prepare draft
easements.

c. Requests by the Town of Littleton (#6) and the Urban
Drainage and Flood Control District (#7) for clean up of
the South Platte River Channel. Your description is too
vague to determine if an easement or an intergovernmental
memorandum of agreement is required. If you will provide
me with the specific details in writing, the appropriate
documents can be drafted.

Both the City of Littleton and CDOT have construction projects
in this area. Their right-of-way people may be able to
provide you with the fair market value of the easements
requested. If not, the Board may need to obtain an appraisal
or other acceptable determination of the value of the ease-
ments requested.

2. Storm drainage easements:

This type of easement request has a different legal
analysis. This will be covered in the attorney-client
memo to the Board. Once the Board determines how it
wishes to proceed in this area, the appropriate docu-
ments, if necessary, can be prepared. The following
requests are covered:

a. Wiggins & Ackerman culvert (#1)

b. Federal Express weir (#4)

c. Waste Management, Inc. culvert (#5). We recommend
that you check with the Colorado Department of Health and
any appropriate local entities to determine if all of
these entities requesting easements:

1) have all necessary permits

2) are in compliance with all necessary permits

3) are involved in or have been involved in any
proceedings for violations of any such permits or
