<br />97-1. Statutory authorization. <br /> <br />The regulations contained herein for flood prevention and control are <br />adopted pursuant to, inter alia, Title 29, Article 20, Section 101, et seq; <br />Title 31, Article 23, Section 201, et seq.; and Title 24, Article 65.1, <br />Section 101, et seq., Colorado Revised Statutes 1973, as amended. <br /> <br />97-2. Findings of fact. <br /> <br />A, The Council of the Town of Frisco finds that there are, within the <br />Town of Frisco, floodplains which constitute natural hazards of <br />state and local interest and are subject to periodic inundation <br />which results in loss of life and property, health and safety <br />hazards, disruption of commerce and governmental services, <br />extraordinary public expenditures for flood protection and relief <br />and impairment of the tax base, all of which adversely affect the <br />public health, safety and general welfare unless appropriate <br />regulations are adopted concerning the use and occupation of such <br />hazard areas. <br /> <br />B. The Town Council further finds that losses are caused by the <br />cumulative effect of obstructions in areas of special flood hazard <br />which increase flood heights and velocities and, when inadequately <br />anchored, damage uses in other areas. Uses that are inadequately <br />floodproofed, underelevated or otherwise unprotected from flood <br />damage also contribute to the flood 1055, <br /> <br />97-3. Purpose. <br /> <br />The purpose of these regulations is to promote the public health, <br />safety and general welfare and minimize flood hazards and losses by <br />provisions designed to: <br /> <br />A, Promote sound planning and land use and permit only such uses <br />within flood plains that will not endanger life, health and public <br />safety or property in times of flooding. <br /> <br />B. Protect the public from avoidable financial expenditures for flood <br />control projects, flood relief measures and the repair and <br />restoration of damaged public facilities. <br /> <br />C. Prevent avoidable interruption of business and commerce. <br /> <br />D. Minimize victimization of unwary home and land purchasers and <br />ensure that potential buyers are notified that property is in area <br />of special flood hazard. <br /> <br />E. Facilitate the administration of flood hazard areas by establishing <br />requirements that must be met before use or development is <br />permit ted. <br /> <br />F. Minimize damage to public facilities and utilities such as water, <br />sewer and gas mains, electric and telephone lines, as well as <br />streets and bridges, located in areas of special flood hazard. <br /> <br />Page 2 <br />
